HomeMy WebLinkAboutO-1067ORDINANCE No. 1067 AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 557 TO ESTABLISH REGULATIONS REGARDING THE CONSTRUCTION OF FENCES IN ORDER TO PROTECT PROPERTY VALUES, RIGHTS, AND PRIVILEGES, AND PROTECT THE SAFETY AND GENERAL WELFARE OF THE PEOPLE: The ordinance known as the Zoning Ordinance (No. 557), adopted 11 August 1975, together with the Zoning Map of the City of Fairhope, Alabama be and the same hereby is changes and altered in respect to the certain property described below: WHEREAS, the City of Fairhope, Alabama has identified the need to protect property values by establishing regulations regarding fences; and, WHEREAS, the City of Fairhope, Alabama desires to allow fences to be constructed that do not pose a threat to the safety of the public or to private property; THEREFORE, be it Ordained by the City Council of the City of Fairhope, Alabama that: 1. Article 7, Special Provisions be amended to insert a new Section 70.7; Fence Regulations that shall read as follows: Section 70.7 Fence Regulations Fences are permitted in every zoning district by right. A building permit must be obtained before construction begins. All fences must adhere to the following requirements: Fences in Residential Zoning Districts: Maximum Height: 8 feet Permitted Materials: Any materials may be permitted to be used as a fence except: a. No corrugated metal shall be permitted. b. No solid sheets of metal shall be permitted. c. No plywood, particle board or similar materials shall be permitted. d. No barbed wire, razor wire, or similar materials may be used in conjunction with a residential fence; except for Agricultural purposes in a RA -Residential Agricultural zone. Fences in Commercial or Industrial Districts: Maximum Height: 12 feet Permitted Materials: Any materials may be permitted to be used as a fence except: a. No corrugated metal shall be permitted b. No solid sheets of metal shall be permitted. c. No plywood, particle board, or similar materials shall be permitted. d. No razor wire shall be permitted. e. No barbed wire shall be permitted in a commercial district (it may be permitted in an industrial district). Ordinance No. 1067 Page -2- Fence Placement for all Zoning Districts: Fences may be permitted on property lines or anywhere else on the lot provided that: a. Fences shall not be constructed in a drainage easement, flood way, or other watercourse. b. Fences may be constructed in a utility easement. c. Fences shall not be constructed in visibility triangles. d. Fences forward of the building line in residential districts shall not exceed 4 feet in height. 2. Severability Clause. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be unconstitutional or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. 3. Currently, the City has no guidelines for fences., Fences may be any height and constructed of any material. In order to protect private property values, the Planning Department has created some basic regulations governing fences. Basically the attached Ordinance spells out maximum fence heights and some rudimentary construction materials. The proposed Ordinance is attached for your review. The Planning Commission considered this at the September 7, 1999 meeting and recommended approval.
