AN ORDINANCE AMENDING ORDINANCE NO. 557 KNOWN AS THE
ZONING ORDINANCE TO REZONE PROPERTY IN
ACCORDANCE WITH APPLICABLE STATE REQUIREMENTS
The ordinance known as the Zoning Ordinance (no. 577), adopted 11 August
1975, together with the Zoning Map of the City of Fairhope, Alabama be and the
same hereby is changes and altered in respect to the certain property described
below:
WHEREAS, the City of Fairhope has received a request for a change in zoning
district boundaries from Mr. Bill Callies; and,
WHEREAS, Mr. Callies's property is currently zoned RA -Residential
Agriculture, and
WHEREAS, Mr. Callies seeks to change the zoning to R2-Single Family
Residential, and
WHEREAS, after appropriate public notice and hearing, the Planning and
Zoning Commission of the City of Fairhope, Alabama, has forwarded a
recommendation to the City Council for amendment of Ordinance No. 557 and
the Official Zoning Map by re -zoning certain property as set forth herein;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAIRHOPE, ALABAMA:
The property is located on Beecher Street, East of Greeno Road (case
Number zc 99-09). The following described property shall be re -zoned from
RA- Residential Agriculture to R2-Single Family Residential;
Property Legal Description:
From the Southeast corner of the Northwest Quarter of the Southeast Quarter
of Section 16, Township 6 South, Range 2 East, Baldwin County, Alabama run
North 00 degrees, 31', 34" East, 20 feet to the POINT OF BEGINNING;
Thence, continue North 00 degrees 31' 34" East, 641.43 feet to a point; Thence
run North 89 degrees 53' West, 280.52 feet to a point; Thence, run South 00
degrees. 21', 21" West 406.32 feet to a point; Thence, run South 00 degrees,
38', 45" West 235.92 feet to a point on the North right-of-way line of Morphy
Avenue; Thence, run North 89 degrees, 57' East along said North right-of-way
line 279.82 feet to the POINT OF BEGINNING. Said parcel of land contains
4.1 acres, more or less.
2. SEVERABILITY CLAUSE. If any section, subsection, sentence, clause,
or phrase of this ordinance is for any reason held to be unconstitutional
or otherwise invalid by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance.
3. EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after is passage as provided for in State Law.
