FRICHTER AND DIANE B. FRICHTER the owners of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying contiguous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: LEGAL DESCRIPTION: 7209 Forest Park, Montrose, Alabama, more particularly described as follows: Lot 3, Forest Park, a re -subdivision of Lots 1 and 2, Block 2, Village of Montrose, according ±o the Plat thereof recorded in may Box 8, page 95, of the records in the Office of the Judge of Probate, Baldwin County, Alabama. SUBJECT, HOWEVER, TO THE FOLLOWING: 1. Restrictive covenants as shown on the recorded plat of said subdivision. 2. Restrictive covenants as contained in deed from Tarascam, Inc., an Alabama corporation to Margaret G. Glover dated September 20, 1973, and recorded in Deed Book 452, Page 715. 3. Statutory right of redemption of John D. Glover, as Executor of the Estate of Margaret G. Glover, deceased, and all other parties lawfully entitled thereto pursuant to Title 6-5-248, et seq., Code of Alabama, 1975 and the amendments thereto which right of redemption arises from foreclosure of the mortgage from Margaret G. Glover, an unmarried woman to The Bank of Mobile dated October 23, 1992, and recorded in Real Property Book 483, page 1327, said foreclosure being held February 1,1994, and evidenced by foreclosure deed dated February 1, 1994, and recorded in Real Property Book 555, Page 355.
