HERNDON III the owners of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; and WHEREAS, the subject land is in the county's single-family zoning district (R-1), does not contain any use permitted in the zoning district and is greater than 100 feet in frontage and greater then 15,000 square feet in area; and THEREFORE, pursuant to Section 8.8 of the Fairhope Zoning Ordinance, the subject land is zoned R-1, concurrent with its annexation. Since there are no lawful uses exiting upon the land, there are no legal con -conformities associated with its annexation into the City of Fairhope; NOW THEREFORE BE IT OPkD�>,INED B`r' THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying contiguous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: PROPERTY DESCRIBED AS: From the Southwest corner of fractional Section 19, Township 6 south, Range 2 East, Baldwin County, Alabama, run North along the West line of said Section 19, a distance of 1943.95 feet to a point of the East right -of -was line of Scenic Highway 98; thence run North 30 degrees 45 minutes East, along said East right-of-way line, a distance of 50.89 feet to an iron pin for the point of beginning; thence run North 89 degrees 45 minutes East, a distance of 298.00 feet to an iron pin, being the Southwest Corner of Lot 1, of Chatwood acres; thence run North 00 degrees 00 minutes 12 seconds East, a distance of 189.4 feet to an iron pin, lying on the South right-of-way line of Nelson Road; thence run South 89 degrees 26 minutes 57 seconds West, along said South right-of-way line, a distance of 200.23 feet to an iron pin at the intersection, with the East right-of-way line of Scenic Highway 98; thence run South 27 degrees 25 minutes 04 seconds West, along said East right-of-way line, a distance of 212.37 feet to the point of beginning.
