SEP 1 9 29 AN '99 M: ... ��cEu : ,.►�.ipG R�DI.1�:�� .!U0Gr; OF PADeATE ORDINANCE NO. 1032 WHEREAS, BAY VENTURES, L.L.C. the owners of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying contiguous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: LEGAL DESCRIPTIONS: The West 245 feet of Lot 1, the West 325 feet of Lot 2, and Lot 3, Square 17, Village of Montrose, as recorded in Deed Book E, Page 388, of the records in the office of the Judge of Probate, Baldwin County, Alabama, more particularly described as follows: Commencing at a 5/8" rebar at the Northeast corner of Lot 1, Square 17, Village of Montrose, as recorded in Deed Book E, Page 388, of the records in the office of the Judge of Probate, Baldwin County, Alabama thence run south 76 degrees 00 minutes West and along the south line of Taylor Street (66' R/W) a distance of 380.42 feet to a 5/8" capped rebar (PLS 20364) at the point of Beginning of the following described parcel; thence continue South 76 degrees 00 minutes West and along said Taylor Street a distance of 244.87 feet to a 5/8" rebar at a point where the south right-of-way line of Taylor Street (66 feet R/W) intersects the east right- of-way line of Second Street (66' R/W); thence run South 13 degrees 51 minutes 40 seconds East and along the east line of Second Street a distance of 624.90 feet to a 5/8" rebar at a point where the east right-of-way line of Second Street intersects the north right-of-way line of Ledyard Street (66' R/W); thence run North 76 degrees 00 minutes 53 seconds East and along the north right-of-way line of Ledyard Street a distance of 625.77 feet to a'/z" open top pipe at a point where the north right -of -.ay line of Ledyaard Stc:-ct intersec s the west right-of-way line of Third Street (66' R/W) thence run North 13 degrees 54 minutes 21 seconds West along the west right-of-way line of Third Street a distance of 208.60 feet to a 5/8" capped rebar (PLS) 20364) at the northeast corder of Lot 3, Square 17, of said Village of Montrose; thence run South 75 degrees 51 minutes 38 seconds West and along the north line of said Lot 3 a distance of 300.29 feet to a 5/8" rebar; thence run North 13 degrees 55 minutes 29 seconds West a distance of 208.59 feet to a 5/8" capped rebar (PLS) 20364) on the north line of Lot 2, Square 17, of said Village of Montrose; thence run South 76 degrees 00 minutes West and along the north line of said Lot 2 a distance of 80.00 feet to a 5/8" capped rebar (PLS 20364); thence run north 13 degrees 55 minutes 29 seconds West a distance of 208.60 feet to the point of beginning. The described parcel contains 5.72 acres more or less. BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin p County, Alabama. o C This Ordinance shall take effect immediately upon its due adoption and publication as required by law.
