AN ORDINANCE TO PROVIDE FOR THE PUBLIC HEALTH, SAFETY,
AND WELFARE OF THE PEOPLE OF FAIRHOPE, ALABAMA BY
REGULATING THE LOCATION, SIZE AND FREQUENCY OF
ACCESSWAYS FOR INGRESS AND EGRESS TO AND FROM STREETS
WITHIN THE CITY OF FAIRHOPE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
Section 1. For purposes of this ordinance the term accessway shall mean that
point at which the centerline of any drive or driveway intersects the outer
boundary of any street, road or highway.
Section 2. Accessways upon North Section Street from Alabama 104 and Scenic
98 northward to Greeno Road (U.S. Highway 98) shall not be located nearer than
six hundred (600) feet to any other accessway and shall be provided with
acceleration and deceleration lanes designed by a professional engineer and
certified for traffic safety.
Section 3. Accessways upon Greeno Road (U. S. Highway 98) shall be located
not nearer than 600 feet to other accessways and, where established shall, to the
maximum extent practicable, align with accessways existing on the opposite side
of the highway, within the corporate limits.
Section 4. Accessways upon Alabama Highway 104 west of U. S. Highway 98
shall be located opposite streets existing on the other side of the highway.
Section 5. On all other streets and highways within the city, accessways shall be
spaced not closer together than one hundred fifty (150) feet and, where limited
sight distances or other topographic or traffic conditions so warrant,
acceleration/deceleration lanes or other means of hazard mitigation shall be
required prior to issuance of construction permits by the city.
Section 6. All other provisions of existing ordinances in conflict herewith are, to
the extent of the conflict, hereby repealed.
Section 7. This ordinance shall not be construed to deny access to any parcel or
lot existing of record upon the effective date of this ordinance. Access, however,
shall only be permitted with due regard to traffic safety.
Section 8. Each phrase, sentence, paragraph or section of this ordinance is
severable from all other such phrases, sentences, paragraphs or sections. Should
any such part of this ordinance be declared unconstitutional or invalid by the
courts, such declaration shall not affect any other part or portion of this ordinance.
Section 9. This ordinance shall take effect upon its due adoption and publication
as provided by law.
