AN ORDINANCE AMENDING ORDINANCE NO. 557
KNOWN AS THE ZONING ORDINANCE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, AS FOLLOWS:
The ordinance known as the Zoning Ordinance (No. 557), adopted
11 August 1975, together with the Zoning Map of the City of Fair -
hope, be and the same hereby is changed and altered in respect
to that certain property described below:
Four parcels on the east side of US 98 (Green Road) immediately south of Fairhope Memory
Gardens, owned by HERBERT O. & RUTH L. PIERCE, more properly described as:
PARCEL "A"- From the SW corner of Sec 21, T6S, R2E, run North 907.4 ft, East 40 ft for
POB; thence 5-89-3'-E 340 ft; thence North III ft, N-89°3'-W 340 ft; thence South 111 ft
to POB.
PARCEL 'B'- From the SW Corner of the North Half of the SW Quarter of the SW Quarter of
Sec 21, T6S, R2E, Baldwin County, AL. run East 40 ft to a point; thence run North 110 ft
to the POB; thence run East 200 ft to a point; thence run N-11°53'-E 133.5 ft to a point;
thence run West 227.2 ft to a point on the East right-of-way of Greeno Boulevard (Rd);
thence run South 132.8 ft to the POB.
PARCEL "C"- From the SW Corner of the North Half of the SW Quarter of the SW Quarter of
Sec 21, T6S2 R2E, run East 40 £t to a point on the East margin of Greeno Road, for a POB;
thence run East 150 ft; thence run North 100 ft; thence run West 150 ft to a point on
the said East side of Greeno Road; thence run South along Greeno Road 100 ft to the POB.
Being a lot 100 ft North & South by 150 ft East & West in the SW corner of P.A. Creamer
property, acquired by deed recorded in Deed Book 226, page 498, Baldwin County Probate Records.
PARCEL "D"- Beginning at the SW Corner of the North Half of the SW Quarter of the SW Quarter
of Sec 21, T6S, R2E, run East 40 ft to a point on the East side of Greeno Road; thence
continue East along a fence line 150 ft to the POB; thence run North 100 ft to a point;
thence run East 30 ft to a point; thence run South 100 ft to a point; thence run West
30 ft to the POB.
The classification of said property is hereby changed from
R1 Low Density Single Family Residential to B4 Business & Professional
it shall hereafter be lawful to construct on such property any
structures permitted by Ordinance No. 557 and to use said premises
for any use permitted by Ordinance No. 557; provided the plans
for any structure or building sought to be erected on said property
shall be in compliance with the building laws of the City of Fairhope
and that any structure shall be approved by the Building Official
of the City of Fairhope and that any such structure be erected
only in compliance with such laws, including the requirements
of Ordinance No. 557.
