DYAS the owner of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation and zoning under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying conti- guous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police -jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: Olympia C. Dyas property immediately adjacent to the south of Montrose Woods Drive and east of US Highway 98, more properly described as: Commence at the SW Corner of Lot 25, Montrose Woods Unit I, as recorded in Map Book 10, p 84, Baldwin County Probate Records, and run thence S-89025130"-E, 176.46 ft to an iron pipe; thence continue S-89'25130"-E, 74 ft to a point in the center of Rock Creek; thence run South following the meanders of said Rock Creek, 265 ft, more or less, to a point in the Center of Rock Creek; thence run S-74°38'33"-W, 20 ft to an iron pipe; thence continue S-740-38133"-W, 786.29 ft to an iron pipe on the East Boundary of US 98; thence run North - westwardly along a curve to the left; having a radius of 6985.49 ft, an are distance of 105.81 ft to a concrete right- of-way monument; thence run N-76028128"-E, 10.0 ft to a concrete right-of-way monument; thence run Northwestwardly along a curve to the left, having a radius of 6995.49 ft, an are distance of 104.5 ft to an iron pin; thence run N-74037117"-E, along the South boundary of Montrose Woods Drive, 412.46 ft to an iron pipe; thence run Northeastwardly along a curve to the left, having a radius of 280.15 ft, an arc distance of 237.58 ft to the POB; said parcel containing 4.5 acres, more or less. BE IT FURTHER ORDAINED that this property will be zoned R-3 PGH, Patio Homes, concurrent with annexation; and BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin County, Alabama.
