WHEREAS, ROBERT G. AND SUE M. EUBANKS the owners
of the hereinafter described property, did, in writing, petition
the City of Fairhope, a municipal corporation, for annexation
under Section 11-42-21 of the Code of Alabama, 1975, as amended;
and
WHEREAS, a map of said property is attached to said Petition
as an exhibit; NOW, THEREFORE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following described property, lying conti-
guous to the corporate limits of the City of Fairhope, Alabama;
and not within the corporate limits or the police jurisdiction
of any other municipality; be and the' same is hereby annexed
to the City of Fairhope, Alabama, to -wit:
Property located in Montrose, from Oak Lane Circle to eastern shore of
Mobile Bay, more properly described as:
Lot 3, Oak Lane a subdivision, according to map or plat thereof recorded
in Map Book 12, page 86, in the office of the Judge of Probate of Baldwin
County, Alabama, and being subject to the Declaration of Covenants,
Restrictions and Easements for Oak Lane containing provisions for
assessments and liens on said property which declaration is dated
6 February 1985 and recorded in Misc Book 52, pages 1639-1662, Baldwin o
County Probate Records. �.

BE IT FURTHER ORDAINED that a certified copy of this Ordinance,
with a copy of the Petition and the exhibit, be recorded N,
in the Office of the Probate Judge, Baldwin County, Alabama.

This Ordinance shall take effect immediately upon its due
adoption and publication as required by law.

We, the undersigned PETITIONER/S, owner/s of the .lands
lands in fee simple described in the attached Exhibit
A, such property being without the Corporate Limits of the
City of. Fairhope, Alabama, but being contiguous to the
said corporate limits, and such properly riot lying within
the corporate limits or police jurisdiction of any other
municipality, do, by these presents, hereby petition the
City of Fairhope, a municipal corporation, that said
property be annexed into the City of Fairhope, Alabama.
The subject land is delineated on the map attached hereto
as Exhibit B.
This Petition is filed under authority of Section
1 1-•42••21 , Code of Alabama, 1975, as amended.

KNOW ALL MEN BY THESE PRESENTS, that SOUTHEASTERN
TERMINAL CORPORATION, an Alabama corporation, hereinafter
called the Grantor, in consideration of the sum of ONE

($145,000.00), of which the sum of FORTY-THREE THOUSAND FIVE

acknowledged to have been paid to the Grantor by ROBERT G.
EUBANKS and SUE M. EUBANKS, hereinafter called the Grantees,
and the balance of which is payable as hereinafter set

CONVEY unto the said Grantees, for and during their joint
lives, and upon the death of either of them, then to the
