HomeMy WebLinkAboutO-932ORDINANCE NO. 7.3,2- AN ORDINANCE AMENDING ORDINANCE NO. 557 KNOWN AS THE ZONING ORDINANCE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, AS FOLLOWS: The ordinance known as the Zoning Ordinance (No. 557), adopted 11 August 1975, together with the Zoning Map of the City of Fair - hope, be and the same hereby is changed and altered in respect to that certain property described below: ROCK CREEK ESTATES, A DEVELOPMENT OF H/M PARTNERS AND MAGNOLIA TRACE, INC.; LOCATED NORTH OF CITY OF FAIRHOPE AND EAST OF US HIGHWAY 98: Beginning at a 2" iron pipe at the Southeast corner of Section 32, T5S, R2E, Baldwin County, Alabama; run thence South 89*59'43"-W 878.13 ft to a 2" iron pipe; thence run North 88'30150"-W 706.29 ft to a point; thence run North 02*46125"-W 804.12 ft to a point; thence run North 89°07'52"-W 395.41 ft to an iron pin; thence run North 02*46125"-W 322.90 ft to a point; thence run North 89°06'16"-W 317.5 ft to a point on the East right-of-way line of U.S. Highway 98; thence along said East right-of-way line of U.S. Highway 98 run North 02035144"-W 838.02 ft to the P.C. of a curve to the left having a radius of 701-5.50 ft; thence continuing along said East right-of-way line of U.S. Highway 98 run Northwardly along the arc of said curve 504.11 ft to a concrete right-of-way monument; thence continuing along said East right-of-way line of U.S. Highway 98 run South 83*17'14"-W 30 ft to a concrete right-of-way mon- ument; said point being on the arc of a 6985.50 ft radius curve concave westwardly; thence continuing along said East right-of-way line of U.S. Highway 98 run Northwardly along said arc of curve 806.72 ft to a point; thence run North 74038133"-E 806.15 ft, more or less, to a point on the centerline of Rock Creek; thence along the meanderings of said centerline of Rock Creek and the East boundary of Montrose Woods, Unit One, as recorded in Map Book 10, page 84, of the Probate Court records, Baldwin County, Alabama; run Northwardly 1904 ft, more or less, to the Northeast corner of said Montrose Woods, Unit One; said point being on the South line of Section 29, T5S, R2E, Baldwin County, Alabama; thence along the North boundary of said Montrose Woods, Unit One, and said South line of Section 29, T5S, R2E, run North 89*13'20"-W 760.79 ft, more or less, to the Southwest corner of the Southeast Quarter of said Section 29, T5S, R2E; thence run North 00*28107"-E 1259.35 ft to an open top iron pipe at a fence corner; thence run North 00024123"-W 1-335.77 ft to an iron pipe at the Northwest corner of said Southeast Quarter of Section 29, T5S, R2E; thence along the North line of said Southeast Quarter of Section 29, T5S, R2E; run North 89*45'41"-E 2623.41 ft to an old axle at the Northeast corner of said Southeast Quarter of Section 29, T5S, R2E; thence along the East line of said Section 29, T5S, R2E, run South 00°21'19"-E 2641.87 ft to a 3" iron pipe at the Northeast corner of the afore- mentioned Section 32, T5S, R2E; thence along the East line of Section 32, T5S, R2E, run South 01044133"-W 5278.44 ft to the point of beginning. Contains 413.0 acres, more or less. The classification of said property is hereby established as a PLANNED UNIT DEVELOPMENT and it shall hereafter be lawful to construct on such property any structures permitted by Ordinance No. 557 and to use said premises for any use permitted by Ordinance No. 557; provided the plans for any structure or building sought to be erected on said property shall be in compliance with the building laws of the City of Fairhope and that any structure shall be approved by the Building Official of the City of Fairhope and that any such structure be erected only in compliance with such laws, including the requirements of Ordinance No. 557.
