WHEREAS, H/M PARTNERS and MAGNOLIA TRACE, INC., the owners of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying conti- guous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: Commencing at the Southeast corner of Section 29, T5S, R2E, Baldwin County, Alabama, run N-00'21'19"-W along the East line of said 3! Section 29, a distance of 2411.23 ft to a point on the North city O limits line of the City of Fairhope, Alabama, as amended by Petition No. 9; said point being the point of beginning of the property -.1 herein described; thence continuing N-00'21'19"-W along said East 0D line of Section 29 run 115.32 ft to a point on a line located half m way between the extreme Southern boundary of the City of Daphne, O Alabama, and said North city limits line of the City of Fairhope, .a Alabama, as amended by Petition #9; thence along said half way line run Q S-89045'41"-W 2623.31 ft to a point on the West line of the Southeast Quarter of said Section 29, T5S, R2E; thence along said West line of the Southeast Quarter of Section 29 run Southwardly 115.32 ft to a point on the aforementioned North city limits line of the City of Fairhope, Alabama, as amended by Petition #9; thence along said North city limits line of the City of Fairhope, Alabama, as amended by Petition #9 run N-89°45'41"-E 2623.21 ft to the point of beginning. A� STATE OF ALABAMA BALDWIN COUNTY We, the undersigned PETITIONERS, owners of the within described lands in fee simple, such property being without the corporate limits of the City of Fairhope, Alabama, but as of the date of the hearing of this petition by the City of Fairhope shall be contiguous to the said corporate limits, and such property not lying within the corporate limits of any other municipality, do, by these presents, hereby petition the City of Fairhope, a municipal corporation, that said property be annexed into the City of Fairhope, Alabama pursuant to the authority of section 11-42-21 of the Code of Alabama (1975). We, the undersigned PETITIONERS further petition that the Honorable Mayor and City Council of Fairhope, Alabama, set a date for the bearing of this petition. We, the undersigned PETITIONERS also ask that the Honorable Mayor and City Council of the City of Fairhope, Alabama, do all things necessary and requisite to comply with the terms of section 11-42-21 of the Code of -Alabama (1975). The subject land, consisting of one parcel, is more particularly described on the attached Exhibit A, and lies immediately north of and contiguous to the corporate limits of the City of Fairhope, Alabama.
