WHEREAS, H/M Partners and Magnolia Trace, Inc., the owners
of the hereinafter described property, did, in writing, petition
the City of Fairhope, a municipal corporation, for annexation
under Section 11-42-21 of the Code of Alabama, 1975, as amended;
and
WHEREAS, a map of said property is attached to said Petition
as an exhibit; NOW, THEREFORE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following described property, lying conti-
guous to the corporate limits of the City of Fairhope, Alabama;
and not within the corporate limits of any other municipality;
be and the same is hereby annexed to the City of Fairhope, Alabama, p

Commencing at a 2" iron pipe at the Southeast corner of Section 32,
T5S-R2E, Baldwin County, Alabama, run N 01° 44' 33" E along the East
line of said Section 32, a distance of 3085.82 feet to a point on the
North city limits line of the City of Fairhope, Alabama, as amended by
Petition Number One; said point being the point of beginning of the
property herein described; thence continuing N 010 44' 33" E along said
East line of Section 32 run 1542.91 feet to a point on a line located
half way between a line running Eastwardly from th extreme Southern
boundary of the City of Daphne, Alabama, where it intersects the West
line of U.S. Highway 98 and the North city limits line of the City of
Fairhope, Alabama, as amended by Petition Number One; thence along said
half way line run S 891 45' 41" W 1790 feet, more or less, to a point
on the centerline of Rock Creek; said point also being on the East
boundary of Montrose Woods, Unit One, as recorded in Map Book 10, Page
84 of the Probate Court Records, Baldwin County, Alabama; thence along
the meanderings of said centerline of Rock Creek and said East boundary
of Montrose Woods run Southwardly 1204 feet, more or less, to a point;
thence run S 741 38' 33" W 806.15 feet, more or less, to a point on the
East right of way line of U.S. Highway 98; said point being on the arc
of a 6985.50 foot radius curve concave Westwardly; thence along said
East right of way line of U.S. Highway 98 and said arc of curve run
Southwardly 216.59 feet to a point on the aforementioned North city
limits line of the City of Fairhope, Alabama, as amended by Petition
Number One; thence along said North city limits line of the City of
Fairhope, Alabama, as amended by Petition Number One run N 890 45' 41"
E 2647.68 feet, more or less, to the point of beginning. Containing
71.12 Acres, more or less.
BE IT FURTHER ORDAINED that a certified copy of this Ordinance,
with a copy of the Petition and the exhibit, be recorded in the
Ord No.

We, the undersigned PETITIONERS, owners of the within described lands
in fee simple, such property being without the corporate limits of the City of Fairhope,
Alabama, but as of the date of the hearing of this petition by the City of Fairhope shall be
contiguous to the said corporate limits, and such property not lying within the corporate
limits of any other municipality, do, by these presents, hereby petition the City of Fairhope,
a municipal corporation, that said property be annexed into the City of Fairhope, Alabama
pursuant to the authority of section 11-42-21 of the Code of Alabama (1975).
We, the undersigned PETITIONERS further petition that the Honorable
Mayor and City Council of Fairhope, Alabama, set a date for the hearing of this petition.
We, the undersigned PETTIIONERS also ask that the Honorable Mayor and
City Council of the City of Fairhope, Alabama, do all things necessary and requisite to
comply with the terms of section 11-42-21 of the Code of Alabama (1975).
The subject land, consisting of one parcel, is more particularly described on
the attached Exhibit A, and lies immediately north of and contiguous to the corporate limitsM
of the City of Fairhope, Alabama. A map identifying the subject land is attached hereto aso
