ORDINANCE NO. 887
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, AS FOLLOWS:
Section 1. It is hereby established and declared that the
following described real property of the City of Fairhope,
Alabama, is no longer needed for public or municipal purposes;
to -wit:
Phase I: T-Hangar Building, Tie -Down Apron, the ramp area
adjacent to Hangars 1, 2, and 3, South Hangar (#3), and ground
floor of Pilot's Lounge building;
Phase II: all airport buildings, the ramp area adjacent to
Hangars 1, 2, and 3, the parking lots in front of Hangar #1 and
between Hangars #1 and #2, and tie -down apron. All located at
the Fairhope Municipal Airport.
Section 2. The City of Fairhope, Alabama, having received an
offer from CLARK AVIATION, INC., an Alabama corporation, Bay
Minette, Alabama, to lease that real property described in
Section 1, above, it is hereby declared to be in the best
interest of the public and the City of Fairhope, Alabama, to
lease said real property to CLARK AVIATION, INC., under the
following terms and conditions, to -wit:
Ten-year lease with two five-year options. At end of initial
three years, business plan review.
Rent to be reviewed every five years.
Phase I: Rent $2,000 per month. Phase II: Rent $6,500 per
month.
Section 3. Pursuant to the authority granted by Section 11-47-
21 of the Alabama Code of 1975, the Mayor of the City of
Fairhope, Alabama, is hereby directed to execute a lease
agreement with CLARK AVIATION, INC., for the City of Fairhope,
Alabama, according to the terms set out in Section 2, above,
and he is hereby authorized to execute said lease agreement in
the name of the City of Fairhope,Alabama.
Section 4. This ordinance shall become effective immediately
upon its adoption and publication as required by law.
