HomeMy WebLinkAboutO-874cI -oL L CL© I i zr UJI F._ p c� O !1 O ORDINANCE NO. 0 / AN ORDINANCE TO AMEND ZONING ORDINANCE NO. 557, SECTION 7.6153 AND 7.6154 (ACCESSORY BUILDINGS); SECTION 8.9 (PENALTIES); AND TO ADD A NEW SECTION: #5.7 PARKING DISTRICT P-1. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, AS FOLLOWS: I. Section 7.6153 is hereby amended to read as follows: "No detached accessory building may exceed the allowable height for structures in the district in which such accessory building is located." II. Section 7.6154 is hereby amended to read as follows: "No detached accessory building shall be located within the minimum exterior front yard of a lot. No detached accessory building shall be located nearer to a side street than the principal structure which it serves." III. Section 8.9 is hereby amended to read as follows: "Any person violating any provision of this Ordinance shall be fined upon conviction, not less than twenty-five dollars ($25.00) nor more than two hundred fifty dollars ($250.00) and court costs for each offense. Violation of any provision of this Ordinance may also be punished by issuance of a Municipal Offense Ticket as provided by Ordinance No. 862." IV. The following new Section is hereby added: "5.7 P-1 PARKING DISTRICT The Parking District designates one or more lots, parcels, tracts, or sites to be used exclusively for the parking of vehicles, either outdoors or indoors. Lands in the P-1 District shall not be used for the construction of any building or structure other than specifically permitted herein. 5.71 Uses Permitted: Parking lots when constructed and landscaped in full conformity with the requirements of this ordinance. 5.72 Uses Permitted on Appeal: Parking garages where the Board of Adjustments and Appeals has determined the use to be compatible with other uses existing in the neighborhood. 5.73 Uses Prohibited: Any use not specifically permitted or permitted on appeal and commercial sales lots for vehicles, mobile homes or other outdoor sales' Any use involving non -operating vehicles in violation of Section 12-11, Code of Ordinances, or any other use in violation of laws or ordinances. 5.74 Existing Buildings or Structures: Lands occupied by buildings or struc- tures shall not be designated P-1 while such buildings or structures exist thereon. 5.75 Lot Area, Width and Maximum Coverage: None specified, except that lot shall be of sufficient size to accomodate the number of parking spaces proposed, with required space for maneuvering, and the landscaping re- quired by this ordinance. 5.76 Maximum Building Height: Upon special exception for a parking garage having been granted by the Board of Adjustments & Appeals, no parking garage shall exceed two stories or thirty feet in height except upon approval of the Planning Commission. 5.77 Yard Requirements: None specified except setbacks on primary and secondary perimeter for landscaping as otherwise required by this ordinance."
