BAGLEY the owner of the hereinafter described property, did, in writing, petition the City of Fairhope, a municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975, as amended; and WHEREAS, a map of said property is attached to said Petition as an exhibit; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA, that the following described property, lying conti- guous to the corporate limits of the City of Fairhope, Alabama; and not within the corporate limits or the police jurisdiction of any other municipality; be and the same is hereby annexed to the City of Fairhope, Alabama, to -wit: The property owned by R. B. BAGLEY is located southwest of the City on the west side of South Mobile Avenue; more properly described as: From the southwest corner of Section 19, T6S, R2E, Baldwin County, Alabama, run north on Section Line Two, 785 ft to a point on the north line of Overton lot (which point is 10 ft south of the old Hendry fence line); Thence run south 74°8' east 235.4 ft, more or less, along the north line of the said Overton lot to an iron corner stake on the west margin of Federal Highway No. 98, and which point is the southeast corner of lands of Carl L. Bloxham; Thence run north 9030' east 118.5 ft along the said west margin of said Highway to an iron corner stake, which is the northeast corner of said Bloxham lands, and the point of beginning. Thence run north 9°30' east along the margin of said Highway 110 ft to an iron corner stake, which point is the southeast corner of C.D. Barr lands; Thence run north 77'0' west 540.5 ft, more or less, along the south line of said Barr lands to an iron stake on top of the bluff; Thence run south 16'0' west along the top of the bluff 100 ft to an iron stake which is on the north line of said Bloxham lands; Thence run south 76°30' east 535.5 ft, more or less, along the north line of said Bloxham lands to the point of beginning, together with all lands lying between the property herein described and the Eastern Shore of Mobile Bay, together with any and all riparian and or littoral rights thereto belonging, and being in Section 19, T6S, R2E and Section 24, T6S,R1E , and containing 1.58 acres, more or less This is one and the same property as deeded in Deed Book 353 at Pages 452 and 453, wherein Emily Worth Bagley and W. Guy Bagley were named as joint tenants with right of survivorship. Emily Worth Bagley died on 12 October 1987, leaving full ownership to her widower husband, W. Guy Bagley. The estate of Emily Worth Bagley was probated in Jefferson County, Alabama, Probate Case No. 129066. The estate of W. Guy Bagley was probated in Jefferson County, Alabama, Probate Case No. 128725. DWR 429 FAIRHOPE, AL 36533 PETITION FOR ANNEXATION TATE OF ALABAMA OUNTY OF THE UNDERSIGNED PETITIONER, being the Owner of the ereinafter-described land in fee simple, such property being ithout the Corporate Limits of the City of Fairhope, Alabama, ut being contiguous to the said Corporate Limits, and such roperty not lying within the said Corporate Limits or Police urisdiction of any other municipality, hereby petition the ity of Fairhope, a municipal corporation, that said property e annexed into the City of Fairhope, Alabama.
