ORDINANCE NO. 95.21
WHEREAS, the owners of the hereinafter described
property, did, in writing, petition the City of Fairhope, a
municipal corporation, for annexation and zoning under
Section 11-42-21 of the Code of Alabama (1975) as amended;
and
WHEREAS, a map of said property is attached to said
Petition as an exhibit; NOW THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Fairhope,
Alabama, that the following described property lying
contiguous to the corporate limits of the City of Fairhope,
Alabama; and not within the corporate limits or the police
jurisdiction of any other municipality; be and the same is
hereby annexed to the City of Fairhope, to -wit:
Property owned by BTC, INCORPORATED, located south of Gayfer
Avenue Extension and west of County Road 27 (Belforest Road)
and is more properly described as: The northwest 1/4 of the
northeast 1/4 of Section 15, T6S, R2E, Baldwin County,
Alabama, containing 39.33 acres, more or less, EXCEPTING
THEREFROM: Commence at the northeast corner of Section 15,
T6S, R2E and run thence West along the north boundary of said
Section 15 for 1,945.2 ft for the Point of Beginning: thence
continue West along said section line for 285.0 ft; thence
run South 03 degrees, 20 minutes West for 470 ft to an iron
marker; thence run North 88 degrees, 45 minutes East for
308.9 ft to an iron marker; thence run North 00 degrees, 26
minutes East for 462.5 ft to the Point of Beginning;
exception contains 3 acres, more or less, leaving annexed
area at 36.33 acres, more or less, and lies in the northwest
quarter of the northeast quarter of Section 15, Township 6
South, Range 2 East, Baldwin County, Alabama.
BE IT FURTHER ORDAINED by the City of Fairhope, Alabama,
that this property will be zoned R2 Medium Density Single
Family Residential concurrent with annexation; and
BE IT FURTHER ORDAINED by the City of Fairhope, Alabama,
that a certified copy of this Ordinance, with a copy of the
Petition for Annexation and the exhibit, be recorded in the
Office of the Probate Judge, Baldwin County, Alabama.
THIS ORDINANCE shall take effect immediately upon its due
adoption and publication as required by law.

PETITION FOR ANNEXATION
STATE OF ALABAMA
COUNTY OF BALDWIN
I, Thomas Brown, President of BTC, INCORPORATED, the owner of the
hereinafter described land in fee simple, such property being without
the Corporate Limits of the City of Fairhope, Alabama, but being
contiguous to the said Corporate Limits, and such property not lying
within the Corporate Limits or Police Jurisdiction of any other
municipality, do by these presents hereby petition the City of
Fairhope, a municipal corporation, that said property be annexed into
the City of Fairhope, Alabama; and that said property be zoned R2
Medium Density Single Family Residential concurrent with annexation.
This petition is filed under the authority of Section 11-42-21 of
the Code of Alabama (1975) as amended.
The property to be annexed is described as follows and a map
thereof, showing its position in relation to the Fairhope corporate
limits, is attached hereto as an exhibit:
