HomeMy WebLinkAboutO-851ORDINANCE NO. , J AN ORDINANCE AMENDING ORDINANCE NO. 557 KNOWN AS THE ZONING ORDINANCE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, as follows: The Ordinance known as the Zoning Ordinance (No. 557), adopted 11 August 1975, together with the Zoning Map of the City of Fairhope, be and the same hereby is changed and altered in respect to that certain property described below: Property owned by FAIRHOPE SINGLE TAX CORPORATION AND LEASEHOLDER GEORGE KLUMPP, located on the corner of Morphy Avenue and Thompson Hall Road further described as: From the southeast corner of the southeast quarter of the southwest quarter of Section 15, T6S, R2E, Baldwin County, Alabama, run North along the half section line of said Section 15 a distance of 33 ft to a point, thence run North 89 degrees, 59 minutes, 40 seconds West for 33 ft to an iron pin lying on the north margin of a 66-ft right-of-way easement reservation as the Point of Beginning; thence continue North 89 degrees, 59 minutes, 40 seconds West along said north right-of-way margin for 457.21 ft to an iron pin; thence run North 30 degrees, 15 minutes, 20 seconds West for 38.54 ft to an iron pin; thence run North 07 degrees, 09 minutes, 07 seconds West for 378.63 ft to an iron pin; thence run North 20 degrees, 59 minutes, 11 seconds West for 400.32 ft to an iron pin; thence run North 04 degrees, 14 minutes, 38 seconds West for 189.72 ft to an iron pin; thence run North 89 degrees, 51 minutes, 47 seconds East for 350 ft to an iron pin; thence run North 00 degrees, 00 minutes, 55 seconds West for 289.90 ft to an iron pin lying on the south right-of-way margin of Morphy Avenue; thence run North 89 degrees, 51 minutes, 47 seconds East along said south right-of-way margin for 331.20 ft to an iron pin lying on the west right-of-way margin of Thompson Hall Road; thence run South along said west right-of-way margin for 1263.51 ft to the Point of Beginning; said parcel contains 16.5 acres, more or less. The classification of said property is hereby changed from RA Residential/Agriculture to R2 Medium Density Single Family Residential and it shall hereafter be lawful to construct on such property any structures permitted by Ordinance No. 557 and to use said premises for any use permitted by Ordinance No. 557; provided the plans for any structure or building sought to be erected on said property shall be in compliance with the building laws of the City of Fairhope and that any structure shall be approved by the Building Official of the City of Fairhope and that any such structure be erected only in compliance with such laws, including the requirements of Ordinance No. 557.
