WHEREAS, the owners of the hereinafter described
property, did, in writing, petition the City of Fairhope, a
municipal corporation, for annexation under Section 11-42-21
of the Code of Alabama (1975) as amended; and
WHEREAS, a map of said property is attached to said
Petition as an exhibit; NOW THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Fairhope,
Alabama, that the following described property lying
contiguous to the corporate limits of the City of Fairhope,
Alabama; and not within the corporate limits or the police
jurisdiction of any other municipality; be and the same is
hereby annexed to the City of Fairhope, to -wit:
JAMES E. & MARGARET B. SMITH parcel adjacent to the Municipal
Golf Course, legally described as: The northernmost ten feet =�
of the south 1/2 of the southeast 1/4 of the southwest 1/4 of
Section 23, T6S, R2E, together with the west 1/2 of the
southwest 1/4 of the southeast 1/4 of the southwest 1/4 of b
aforesaid Section 23; area approximately 5 acres.
BE IT FURTHER ORDAINED by the City of Fairhope, Alabama,
that this property will be zoned R2 MEDIUM DENSITY SINGLE
FAMILY RESIDENTIAL concurrent with annexation; and
BE IT FURTHER ORDAINED by the City of Fairhope, Alabama,
that a certified copy of this Ordinance, with a copy of the
Petition for Annexation and the exhibit, be recorded in the
Office of the Probate Judge, Baldwin County, Alabama.
THIS ORDINANCE shall take effect immediately upon its due
adoption and publication as required by law.

PETITION FOR ANNEXATION
STATE OF ALABAMA

JAMES EDWARD SMITH and MARGARET BALLARD SMITH, husband
and wife, the "Owners" of the hereinafter -described land in
fee simple (subject to certain easements, mortgages and
minerals interests of public record), such property being
without the Corporate Limits of the City of Fairhope,
Alabama, but being contiguous to the said Corporate Limits,
and such property not lying within the Corporate Limits or
Police Jurisdiction of any other municipality, hereby
petition the City of Fairhope, a municipal corporation, that
said property be annexed into the City of Fairhope, Alabama.
This Petition is filed under authority of Section
11-42-21 of the Code of Alabama (1975) as amended, and is
conditioned upon designation of zoning of such property as
"R-2 Medium Density Single Family Residential".
The property to be annexed is described as:
The northernmost ten feet of the South 1/2 of the
Southeast 1/4 of the Southwest 1/4 of Section 23,
Township 6 South, Range 2 East, together with the
West 1/2 of the Southwest 1/4 of the Southeast 1/4
of the Southwest 1/4 of aforesaid Section 23.
A map thereof is attached hereto as Exhibit A.
