AN ORDINANCE AMENDING ORDINANCE NO. 557
KNOWN AS THE ZONING ORDINANCE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
The Ordinance known as the Zoning Ordinance (No. 557),
adopted 11 August 1975, together with the Zoning Map of the City
of Fairhope, be and the same hereby is changed and altered in
respect to that certain property described below:
Property of ESTATE OF WALTER WILSON, 205 BISHOP ROAD, legally
described as follows: Commence at the southeast corner of the
Northeast Quarter of the Northwest Quarter of Sec 16, T6S, R2E, as
the POINT OF BEGINNING: Thence run north 00 degrees 11 mins east
along the North -south Half Section Line 704.4 ft; thence run south
89 degrees 56 mins west 529.4 ft; thence run south 23.4 ft to a
concrete marker at the Southeast Corner of lands heretofore
conveyed to J. W. Lipscomb; thence run west 140 ft; thence run
south 00 degrees 3 mins west along the east boundary of property
now or formerly of Roubik for 680.8 ft; thence run north 89
degrees 56 mins east for 666.53 ft to the POB. SUBJECT TO a
right-of-way easement over and across the east & south side
thereof. Parcel contains 10 acres, more or less, right-of-way
excluded, and lies in NE Qtr of the NW Qtr of Sec 16, T6S, R2E,
Baldwin County, Alabama.
The classification of said property is hereby changed from R3
High Density Single Family Residential to R5 High Density
Multi -Family Residential and it shall hereafter be lawful to
construct on such property any structures permitted by Ordinance
No. 557 and to use said premises for any use permitted by
Ordinance No. 557; provided the plans for any structure or
building sought to be erected on said property shall be in
compliance with the building laws of the City of Fairhope and that
any structure shall be approved by the Building Official of the
City of Fairhope and that any such structure be erected only in
compliance with such laws, including the requirements of Ordinance
No. 557.
