AN ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS IN QUAIL CREEK ESTATES; FAIRHOPE, BALDWIN COUNTY, ALABAMA BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALA, AS FOLLOWS: SECTION 1: That the following described pump stations and force mains shall be constructed as hereinafter provided between the respective terminal points hereinafter set forth: (a) Pump Station No. 1 shall be constructed on Quail Creek Drive and a 10" force main shall be laid from Pump Station No. 1 westerly along Quail Creek Drive to Baldwin County Highway No. 27; thence run northerly along Baldwin County Highway No.127 to Windmill Road; thence run westerly along Windmill Road to Pump Station No. 2 which will be constructed at the intersection of Windmill Road and Thompson Hall Road, and a 10" force main shall1be laid from Pump Station No. 2 northerly along Thompson Hall Road to Morphy Avenue extension to a receiving manhole on Greeno Road (US Highway 98). Pump Station No. 3 shall be constructed at theleast end of Lake Ridge Road with a 6" force main running northerly to Manhole #19. SECTION 2: That the following described streets in the City of Fairhope shall be improved as hereinafter provided between the respective terminal points hereinafter set forth: (a) QUAIL CREEK DRIVE shall be improved from the east end of the ex- isting pavement on Quail Creek Drive at Station 0+00; thence run easterly to its ending at Station 28+00, a distance of 2,800 feet as follows:. both edges of a 50-foot right-of-way, the center line of which shall be approximately the centerline of the above described portion of said street, shall be curbed and guttered with Portland Cement concrete combination curb and gutter, the curb lines of said gutters to be 6" thick and the gutter to be 216" wide; the curb lines of said gutters shall be connected with the curb lines of all intersecting streets or alleys, with Portland Cement concrete combination curb and gutters as above described, of suitable radius and the surface area between the gutters to be constructed shall be improved by paving with hot mix asphaltic concrete (416-A mix) 12" thick with prime on an 8" thick sand clay base course foundation, said improvements shall include grading and all necessary drainage structures, including concrete culverts, concrete pipe, valley gutters and drop inlets; precast concrete manholes with cast iron covers, 8" PVC sewer pipe and 4" PVC house laterals, 8", 611, and 3" PVC water mains with 3/4" service connections, water meters, and 6" fire hydrants, also including other utilities such as underground power lines, and gas lines. (b) WINDMILL LOOP shall be improved from its intersection with Quail Creek Drive at Station 0+00; thence run northerly and southerly to its intersection again with Quail Creek Drive at Station 14+50, a distance of 1,450 feet as follows: both edges of a 50-foot right-of-way, the centerline of which shall be,approximately the centerline of the above described portion of said street, shall be curbed and guttered with Portland Cement concrete combination curb and gutter, the curb lines of said gutters to be 6" thick and the gutter to be 216" wide; the curb lines of said gutters shall be connected with the curb lines of all intersecting streets or alleys, with Portland Cement concrete combination curb and gutters as above described, of suitable radius and the surface area between the gutters to be constructed shall be improved by paving with hot mix asphaltic concrete (416-A mix) 12" thick with prime on an 8" thick sand clay base course foundation, said improvements shall include grading and all necessary drainage structures, including concrete culverts, concrete pipe, valley gutters and drop inlets; precast concrete manholes with cast iron covers, 8" PVC sewer pipe Imp. SECTION 3: That the full details, drawings, plans, specifications and surveys of the above described work and estimates,which have been prepared by Moore Engineering Associates, have been fully considered and studied by this Council and hereby are adopted. Said details, drawings, plans, specifications, surveys and esti- mates are on file in the office of MOORE ENGINEERING ASSOCIATES, 555 NORTH SECTION STREET, FAIRHOPE, ALABAMA, where property owners who may be affected by such improvements may see and examine the same. SECTION 4: That the improvements hereinabove described shall be made in accordance with grades established by ordinance and according to the full details, drawings, plans, specifications and surveys of said work and estimates herein adopted, all under the supervision of Moore Engineering Associates. SECTION 5: That the cost of constructing said improvements shall bi assess against the property so improved, provided: (a) That the cost of improving any intersection or any part thereof shall be assessed against the lots or parcels of land abutting on each of the streets, avenues, alleys or other highways so intersecting for a half block in each direction therefrom; pro- vided that for the purpose of computing assessments, no block shall be considered as extending more than 1,000 feet from any intersection so improved. (b) That the cost of any sidewalk improvements, including curbing and guttering on street and avenue corners shall be assessed against the lots or parcels of land abutting on or nearest to said improvements, and the cost of sidewalk improvements, in- cluding curbing and guttering at the intersection of any alley with a street, avenue or other highway shall be assessed in fair proportion against the respective lots or parcels of land abutting or cornering on the alley at such intersection. (c) That no assessment shall exceed the cost of the improvements or the increased value of such property by reason of the special benefits derived from such improvements. SECTION 6: That the City Council shall meet on the 9th day of January, 1989, at 5:.30 pm, at the Fairhope Municipal Complex Council Chamber in the City of Fairhope to hear any objections, remonstrances or protests that may be made against said improve- ments, the manner of making the same, or the character of material: to be used. SECTION 7: This ordinance shall be published once a week for two consecutive weeks in the EASTERN SHORE COURIER, a newspaper pub- lished and of general circulation in the City of Fairhope, the date of the first publication to be not less than two weeks before the 9th day of January, 1989. SECTION 8: A copy of this ordinance shall be sent by certified mail, postage prepaid, to the persons last assessing for City taxation the property which may be assessed for said improvements, at their last known addresses, said notices to be mailed by the City Clerk not less than ten days prior to the 9th day of January, 1989.
