ORDINANCE NO. a b 9
BE IT ORDAINED by the City Council of the City of Fairhope, Alabama, as
follows:
Section One. It is hereby established and declared that the following
described real property of the City of Fairhope, Alabama, is no longer needed
for public or municipal purposes, to -wit:
Commence at the point of intersection of the West
right-of-way of Sea Cliff Drive and the division line
between Lot A and Lot B in Sea Cliff, a subdivision
in the City of Fairhope, Alabama, as shown by map or
plat thereof recorded in Deed Book 7, at pages 90-91,
Probate Records, Baldwin County, Alabama,, as the
POINT OF BEGINNING.
From said Point of Beginning run South 36 degrees 04'
27" West, 20.69 feet to a concrete post; thence run
South 60 degrees 58' 40" East, 71.55 feet; thence run
South 47 degrees 17' 55" East, 93.76 feet to an iron
pin marker; thence run South 16 degrees 03' 55" East,
113.7 feet; thence run South 11 degrees 23' 33" East,
139 feet, more or less, to a point on the North
Margin of Fly Creek; thence run in a Northwestwardly
direction, along and following the meanderings of
the North margin of said Fly Creek, a distance of
691 feet, more or less, to point of intersection of
the North margin of said Fly Creek with the Eastern
margin of Mobile Bay; thence run Northeastwardly
along and following the meanderings of said East
margin of Mobile Bay, a distance of 205 feet, more or
less, to a point on the division line between said
Lots A and B; thence run East, 302 feet, more or
less, to the Point of Beginning. Tract contains 2.3
acres, more or less, and lies in the William
Patterson Grant Section 8, Township 6 South, Range 2
East, Baldwin County, Alabama.
Section Two. The Mayor of the City of Fairhope, Alabama, did execute and
deliver the hereinafter described leases and amendments and pursuant to the
authority granted by Section 11-47-21, Code of Alabama (1975), the actions of
the Mayor of the City of Fairhope, Alabama, in the execution and delivery of
the hereinafter described leases and amendments are hereby ratified and
confirmed:
Lease Agreement (Boatyard) between City of Fairhope, Alabama, as Lessor,
and Walter Marine Service, Inc., as Lessee, dated August 24, 1984.
Addendum to Lease (Boatyard) between The City of Fairhope, Alabama, as
Lessor, to Walter Marine Service, Inc., as Lessee, dated January 1,
1986.
Addendum to Lease (Boatyard) between City of Fairhope, Alabama, as
Lessor, to Walter Marine Service, Inc., as Lessee, dated January 1,
1986.

Addendum to Lease (Boatyard) between City of Fairhope, Alabama, as
Lessor, Walter Marine Service, Inc., as Lessee, and Eastern Shore
Marine, Inc., as Assignee, dated uar , 1988.
Addendum to Lease (Boatyard) between City of Fairhope, Alabama, as
Lessor, Walter Marine Services, Inc., as Lessee, and Eastern Shore
Marine, Inc., as Assignee, dated June 20, 1988.
Lease Agreement (Marina) between City of Fairhope, an Alabama Municipal
Corporation, as Lessor, and Walter Marine Service, Inc., as Lessee,
dated May 1, 1987.
Addendum to Lease (Marina) between City of Fairhope, Alabama, as Lessor,
Walter Marine Service, Inc., as Lessee, and Eastern Shore Marine, Inc.,
as Assignee, dated Fcb r-OL °� _, 1988.
Addendum to Lease (Marina) between City of Fairhope, Alabama, as Lessor,
Walter Marine Services, Inc., as Lessee, and Eastern Shore Marine, Inc.,
as Assignee, dated June 20, 1988.
All the above said leases and amendments are maintained in the Office of
the City Clerk of the City of Fairhope, Alabama and shall be found of record in
the Probate Court Records of Baldwin County, Alabama, following the effective
date this ordinance.
Section Three. Pursuant to the authority granted by Section 11-47-21,
Code of Alabama (1975), the Mayor of the City of Fairhope, Alabama, is hereby
directed and authorized in the name of the City of Fairhope to execute the
Addendum to Lease (Boatyard) between City of Fairhope, Alabama, as Lessor,
Walter Marine Services, Inc., as Lessee and Eastern Shore Marine, Inc., as
Assignee bearing the same date hereof and Addendum to Lease (Marina) between
City of Fairhope, Alabama, as Lessor, Walter Marine Services, Inc., as Lessee
and Eastern Shore Marine, Inc., as Assignee bearing same date hereof.
Section Four. It is hereby declared to be in the best interest of the
public and the City of Fairhope, Alabama, to enter into the leases and
amendments, referred to in Sections Two and Three above.
Section Five. The ordinance shall become effective immediately upon its
adoption and publication as required by law.
ADOPTED AND APPROVED this the v?b day of June, 1988.
