AMENDMENTS & ADDITIONS TO ZONING ORDINANCE NO. 557
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE, ALABAMA,
AS FOLLOWS:
I. Section 5.21.1, Uses Permitted, which refers to Section 4.1 is
hereby amended to read as follows:
"Single family dwellings and those uses permitted or permitted on
appeal in Section 5.1."
II. Section 5.31.1. Uses Permitted, which refers to Sections 4.1 and
4.2 is hereby amended to read as follows:
"Single family dwellings and those uses permitted in Sections 5.1 and
5. 2. ti
III. Section 5.411 Uses Permitted, which permits any use permitted on
appeal in an "R" district is hereby amended to read as follows:
"Neighborhood retail stores and markets, including the following types
of stores: food general merchandise, apparel, furniture, household and
hardware, radio and television, drugs and sundries, jewelry and gifts,
florists, sporting goods, pet shops, and similar types. Neighborhood
services including the following: dry cleaning services including
pick-up stations, barber shops, beauty shops, shoe repair, offices,
banks, post offices, theatres, and similar services. Any use permitted
in an "R" district subject to all district requirements except R-6."
IV. Section 5.412 Uses Permitted on Appeal, which permits only
service stations where no major repairs are made on automobiles is
hereby amended to read as follows:
"Service stations where no major repairs are made on automobiles and
any use permitted on appeal in an "R" district."
V. Section 5.422 Uses Permitted on Appeal, which does not provide
for uses permitted on appeal in "R" districts is hereby amended to read
as follows:
"Dry cleaners and laundries; manufacturing incidental to a retail trade
where articles are sold at retail on premises, and any use permitted on
appeal in an "R" district."
VI. Section 5.451 Uses Permitted, which does not provide for uses
permitted on appeal, is hereby amended to read as follows:
"Business and professional offices, agencies and headquarters including
the following types of businesses: doctors, dentists, lawyers,
architects, engineers, chiropractors, real estate, insurance, financial
institutions and similar types.
a. Uses Permitted on Appeal:
Any use permitted on appeal in an "R" district."
VII. Section 5.511 Uses Permitted, which conflicts with Section 5.513,

is hereby amended to read as follows:
"All business, service and manufacturing uses permitted in a B-2
district, Public utilities, Light Industrial operations which are not
obnoxious, offensive or detrimental to neighboring property by reason
of dust, smoke, vibration, noise, odor, or effluent."
VIII. Section 5.513 Uses Prohibited, which does not specifically
exclude hospitals and other institutions for the care of humans is
hereby amended to read as follows:
"Residential structures, hospitals and other institutions for the care
of humans, mobile home parks, slaughter houses, stockyards, bag
cleaning; central mixing plant for cement, mortar, plaster, or paving
materials; curing, tanning or storage of hides; distillation or
rendering processes; manufacturing of flammables, acids, chemicals;
bricks, pottery, terra Gotta, tile or concrete blocks, junk yards,
cotton waste -reclaiming; and similar types of plants or operations."
IX. Section 8.10 Remedies, which does not contain the words
'maintained', or 'any building, structure, or land used' is hereby
amended to read as follows:
"In case any building or structure is to be erected, constructed,
reconstructed, altered, maintained, or converted, or any building,
structure, or land used, in violation of this ordinance, the Zoning
Enforcement Officer, legal officer, or other appropriate authority or
any adjacent or neighboring property owner who would be specifically
damaged by such violation may, in addition to other remedies, institute
injunction, mandamus, or other appropriate action or preceeding to
prevent such unlawful erection, construction, reconstruction,
alteration, conversion maintenance, or use; or to correct or abate such
violation; or to prevent the occupancy of said building, structure or
land. Each and every day such maintenance or use continues shall be
deemed a separate offense."
X. If any section or provision of this ordinance shall be held
invalid, such holding shall not affect the validity of any other
section or provision thereof which is not of itself invalid.
XI. This ordinance shall take effect immediately upon its due
adoption and publication as required by law.
