AN ORDINANCE AMENDING ORDINANCE NO. 557
KNOWN AS THE ZONING ORDINANCE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, as follows:
The Ordinance known as the Zoning Ordinance (No. 557),
adopted 11 August 1975, together with the Zoning Map of the City
of Fairhope, be and the same hereby is changed and altered in
respect to that certain property described below:
FSTC/TOM BROWN PARCEL: Lot 12 of Lessor's unrecorded resubdivision
map of the Nor 1/4 of the SE 1/4 of the NE 1/4, Sec 17, Div 4,
of its land in the City of Fairhope, Alabama, as per its plat
there of filed for record Sept 13, 1911, as approved by the City
Planning Commission Oct 10, 1961, such lot being described by
metes and bounds as follows: Begin on the west side of Greeno Road
at a point which is 40 feet west and 175 feet south of the
northeast corner of said SE 1/4 of NE 1/4 and the southeast corner
of Lot 11 of said resubdivision, thence south 156.56 feet, west
122 feet, north 156.56 feet and east 122 feet to beginning,
subject to prior road agreement 66 former lessees, Fred and Sadie
M. Ingersoll concerning the south 6.56 feet thereof. Sec 17, T6S,
R2E, Baldwin County, Alabama. From the south line of the North
1/4 of the SE 1/4 of the NE 1/4, Sec 17, Div 4, of the land of the
lessor in the City of Fairhope, Alabama, as per plat thereof filed
for record Sept 13, 1911, Misc Book 1, pp 320-321, Probate
records, Baldwin County, Alabama; run north 25 feet to north side
of reserved right of way for point of beginning of the land herein
leased, run thence north 132.4 feet to SW cor Lot 1 as shown on
lessor's unrecorded resubdivision map of said N 1/4 as approved by
the City Planning Commission Oct 10, 1961, run thence east 1140.4
feet to NW cor of Lot 12 of said resubdivision, thence south
132.56 feet to the north side of the reserved right of way and
thence west to point of beginning. 3.46 acres, more or less.
Regard to rezoning: the east 502.3 feet, more or less, of the
above described leasehold.
The classification of said property is hereby changed from R1
Low Density Single Family Residential to B4 Business &
Professional and it shall hereafter be lawful to construct on such
property any structures permitted by Ordinance No. 557 and to use
said premises for any use permitted by Ordinance No. 557; provided
the plans for any structure or building sought to be erected on
said property shall be in compliance with the building laws of the
City of Fairhope and that any structure shall be approved by the
Building Official of the City of Fairhope and that any such
structure be erected only in compliance with such laws, including
