ORDINANCE NO. 774
• AN ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS ON PROSPECT
STREET, BON SECOUR AVENUE NORTH & SOUTH, SCHOOL STREET, HUNT ROAD,
BELLANGE STREET, SHORE VILLAGE DRIVE, SHORE VILLAGE CIRCLE, SHORE
VILLAGE LANE, ECHO LANE WEST, AND NICHOLS STREET EXTENSION IN THE
CITY OF FAIRHOPE, ALABAMA.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
BALDWIN COUNTY, ALABAMA, AS FOLLOWS:
SECTION 1. That the following described improvements and/or
streets in the CITY OF FAIRHOPE shall be improved as hereinafter
provided between the respective terminal points hereinafter set
forth:
(a) PROSPECT STREET. Begin on the west side of Greeno Road and
run approximately 325 feet West to the east side of Pleasant
Street with paving, curb and gutter, and storm drainage.
(b) BON SECOUR AVENUE NORTH. Begin at the intersection of
Forster Avenue and run North approximately 800 feet to the south
edge of pavement on Concord Drive in Richmond Square subdivision
with paving, curb and gutter, and storm drainage.
(c) BON SECOUR AVENUE SOUTH. Begin at the intersection of
Forster Avenue and run South approximately 315 feet to the north
side of Volanta Avenue with paving and curb and gutter.
(c) SCHOOL STREET. Begin at the north side of Nichols Street
and run North approximately 1,280 feet to the south side of Morphy
Avenue with curb and gutter, edge paving and storm drainage.
(d) HUNT ROAD. Begin at the south side of Middle Street and
run South approximately 400 feet with paving, curb and gutter, and
storm drainage.
(e) BELLANGEE STREET. 'Begin at the east side of Young Street
and run East approximately 325 feet with paving, curb and gutter
and storm drainage.
(f) SHORE VILLAGE DRIVE. Begin at the north side of Nelson
Road and run North approximately 230 feet to the south side of
Shore Village Circle and Shore Village Lane with paving, curb and
gutter, storm drainage, sewer and water mains.
(g) SHORE VILLAGE CIRCLE. Begin at the west side of Shore
Village Drive and run West approximately 200 feet with paving,
curb and gutter, sewer and water mains.
(h) SHORE VILLAGE LANE. Begin at the east side of Shore
Village Drive and run East approximately 190 feet with paving,
curb and gutter, storm drainage, sewer and water mains.
(i) ECHO LANE WEST. Begin at the west end of the existing
pavement on Echo Lane West, and run Northerly and Westerly

approximately 920 feet with paving, curb and gutter, water mains,
sewer and storm drainage.
(j) NICHOLS STREET EXTENSION. Begin at the east side of Greeno
Road and run East approximately 660 feet with paving, curb and
gutter, and storm drainage.
SECTION 2. That the general character of the improvements to be
made and the materials to be used are:
STREET PAVING, CURB & GUTTER:
Shall be 25 feet wide and constructed with 8" compacted sand -clay
base with Bituminous prime coat and 1-1/2" bituminous plant mix
pavement (Type 416A) with 6" x 2-112' concrete roll type curb &
gutter.
STORM DRAINAGE:
Shall be constructed with concrete type-S inlets and reinforced
concrete pipe and/or culverts.
SEWERS:
Shall be constructed with 8" PVC, and/or 8" ductile iron pipe with
concrete manholes, 4" sewer laterals, 100 and 200 GPM pumping
stations, and 411, 611, and 8" PVC force mains.
WATER MAINS:
Shall be constructed of 6" or 8" PVC with fire hydrants, valves,
and necessary appurtances.
SECTION 3. That the full details, drawings, plans, specifications
and surveys of the above described work and estimates which have
been prepared by Moore Engineering Company, Inc., the duly
appointed Engineering Consultants for the City of Fairhope, have
been fully considered and studied by this Council and hereby are
adopted. Said details, drawings, plans, specifications, surveys
and estimates are on file in the office of Moore Engineering
Company, 555 North Section Street, where property owners who may
be affected by such improvements may see and examine the same
after 8 September 1986.
SECTION 4. That the improvements hereinabove described shall be
made in accordance with the grades heretofore established by
ordinance and according to the full details, drawings, plans,
specifications and surveys of said work and estimates herein
adopted, all under the supervision of Moore Engineering Company,
Inc.
SECTION 5. That the cost of constructing said improvements shall
be assessed against the property abutting on the portions of the
streets so improved, provided:
(a) that the cost of improving any intersection or any part
thereof shall be assessed against the lots or parcels of land
abutting on each of the streets, avenues, alleys or other highways
so intersecting for a half block in each direction therefrom;
provided that for the purpose of computing assessments, no block
shall be considered as extending more than 1,000 feet from any
intersection so improved.
(b) that the cost of curbing and guttering on street and
avenue corners shall be assessed against the lots or parcels of

land abutting on or nearest to said improvements, and the cost of
curbing and guttering at the intersection of any alley with a
street, avenue or other highway shall be assessed in fair
proportion against the respective lots or parcels of land abutting
or cornering on the alley at such intersection.
(c) that no assessment shall exceed the cost of the
improvements or the increased value of such property by reason of
the special benefits derived from such improvements.
SECTION 6. That the City Council shall meet on the 22nd day of
September, 1986, at 5:30, p.m., at the Fairhope Municipal Complex
Council Chamber, 161 North Section Street, in the City of Fairhope
to hear any objections, remonstrances or protests that may be made
against said improvements, the manner of making the same or the
character of the materials to be used.
SECTION 7. This ordinance shall be published once a week for two
consecutive weeks in the EASTERN SHORE COURIER, a newspaper
published and of general circulation in the City of Fairhope, the
date of the first publication to be 3 September 1986, not less
than two weeks before the 22nd day of September, 1986.
SECTION 8. A copy of this ordinance shall be sent by certified
mail, postage prepaid, to the persons last assessing for City
taxation the property which may be assessed for said improvements,
at their last known addresses, said notices to be so mailed by the
City Clerk not less than ten days prior to the 22nd day of
September, 1986.
