BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA, AS FOLLOWS:
Section 1. It is hereby established and declared that
the following -described real property of the City of
Fairhope, Baldwin County, Alabama, is no longer needed for
public or municipal purposes, to -wit:
From the intersection of the Northwest boundary of
Block 23, Volanta, and the east line of the
right-of-way of Pensacola Avenue in Volanta, which
point is the northwest, or westernmost corner of
said Block 23, according to the original plat of
Volanta recorded in Msc. Book 1, at page 341, of
the records in the office of the Judge of Probate
of Baldwin County, Alabama, run North 65 degrees,
13 minutes, 37 seconds East, 282.81 feet, along
the south line of the right-of-way of Tensaw
Avenue, as shown on said plat, to a point, the
point of beginning; thence run North 17 degrees,
59 minutes, 18 seconds East, 75 feet; thence run
South 72 degrees, 00 minutes, 15 seconds East,
81.1 feet to a point on the west line of the
right-of-way of Section Street (U.S. Highway 98);
thence run South 65 degrees, 13 minutes, 37
seconds West, 110.45 feet to the Point of
Beginning; being the parcel designated as Parcel
"A" and intended to be the same property as
described in that certain deed from John W. Craig
to the City of Fairhope dated March 25, 1963, and
recorded in Deed Book 330, at page 156, of said
records; and
Beginning at the intersection of the
Northwest boundary of Block 23, Volanta, and
the east line of the right-of-way of
Pensacola Avenue in Volanta, which point is
the northwest, or westernmost, corner of said
Block 23, according to the original plat of
Volanta recorded in Msc. Book 1, at page 341,
of the records in the office of the Judge of
Probate of Baldwin County, Alabama, and run
thence North 20 degrees, 09 minutes, 34
seconds East, 637.67 feet to a point on the
west line of the right-of-way of Railroad
Avenue, a street being shown on said plat but
never opened for public use; thence run North
24 degrees, 55 minutes, 44 seconds West,
93.19 feet to a point on the said West line
of the Railroad Avenue right-of-way; thence
run South 20 degrees, 09 minutes, 34 seconds,
West, 637.17 feet to a point on the east line
of the right-of-way of Pensacola Avenue;
thence run South 24 degrees, 46 minutes, 54
seconds East, 93.54 feet to the Point of
Beginning; being the parcel designated as
Parcel "B" and intended to be the same
property as described in said deed from John
W. Craig to the City of Fairhope referred to
above;
EXCEPTING, however, from this conveyance, and
reserving unto the Grantor (City of
Fairhope), all of the oil, gas and other
minerals in, on and under said described real
property, together with all rights therein
and thereto, including the right of
convenient access for the purpose of
exploiting, removing and marketing any such
oil, gas and other minerals.
Section 2: That the Mayor and the City Clerk be, and they
hereby are, authorized and directed to execute and attest,
respectively, for and on behalf of the City of Fairhope, Alabama,
a warranty deed, a copy of which is on file in the Office of the
City Clerk, whereby the City of Fairhope, Alabama, does convey
the premises described in Section 1, hereof to Mary P. Van
Antwerp for and in consideration of the sum of One Dollar ($1.00)
and a deed from Mary P. Van Antwerp to the City of Fairhope to
the following -described real property in the City of Fairhope,
Baldwin County, Alabama, as an exchange of real property:
From the westmost corner of Block 23, Volanta
Subdivision, per plat thereof recorded in Misc.
Book 1, at page 341, of the records in the
office of the Judge of Probate of Baldwin
County, Alabama, run North 20 degrees, 09 minutes,
34 seconds East, 65.74 feet to a point; thence
run South 71 degrees, 50 minutes 57 seconds East,
286.24 feet to an iron pipe on the west
right-of-way line of Section Street; thence run
North 17 degrees, 59 minutes, 18 seconds East,
along said west right-of-way line, 175 feet to a
point marked by an iron rod, this point being
the point of beginning of the conveyed
property; from said point of beginning run North
72 degrees, 02 minutes, 42 seconds West, 65 feet
to an iron rod; thence run North 17 degrees, 59
minutes, 18 seconds East, parallel to the said
west right-of-way line of Section Street, 62.79
feet to an iron rod, thence run South 72 degrees,
02 minutes, 42 seconds East, 65 feet to an iron
pipe on the west right-of-way line of Section
Street; thence run South 17 degrees, 59 minutes,
18 seconds West, along said west right-of-way line
of Section Street, 62.79 feet, to the Point of
Beginning; containing 0.09 acres, more or less.
