AN ORDINANCE TO PROMOTE AND PROTECT THE HEALTH, SAFETY,
AND GENERAL WELFARE OF THE CITIZENS OF FAIRHOPE, ALA,
BY RESTRICTION OF TRUCK TRAFFIC WITHIN RESIDENTIAL AREAS
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE
AS FOLLOWS:
SECTION I. All trucks, as hereinafter defined, are hereby
prohibited upon those certain residential streets within the
area bound by FAIRHOPE AVENUE, INGLESIDE STREET, MORPHY AVENUE,
and GREENO ROAD; provided, however, that trucks may enter and
exit to and from Greeno Road upon the eastern portion of
PROSPECT AVENUE for the purpose of effecting deliveries to the
rear of businesses existing upon Fairhope Avenue.
SECTION II. The word "truck" as used herein is defined to include
any vehicle having more than four (4) wheels, a load capacity of
more than one (1) ton, and not used solely for transport
of passengers.
SECTION III. This ordinance shall not apply to:
(a) Trucks engaged in moving or delivery of household goods,
appliances, and mail to/from individual residences.
(b) Trucks for performing construction or maintenance,
public or private.
(c) All Emergency Vehicles, i.e. Fire, Police,
Ambulance, Public Service.
SECTION IV. This ordinance shall take effect immediately upon
due adoption and publication as required by law.
