AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF
FAIRHOPE, ALABAMA, BE AMENDED BY REVISION OF SECTION 21-21 BY THE
ADOPTION OF THE FOLLOWING ELECTRIC RATES FOR ALL ELECTRIC CUSTOMERS
OF THE CITY.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF M, CITY OF FAIRHOPE, ALABAMA, as
follows:
Section One. Code of Ordinances, City of Fairhope, Alabama, Section 21-21, is
hereby .revised as per the following monthly rates for all electric customers
served by the City:
RESIDENTIAL - R1
Applicable to single residences, individually metered mobile homes, and
individual family apartments where cost of service is paid by the occupant.
First 20 KWH/month for $4.50 Minimum, plus
Next 980 KWH/month @ $0.060, plus
Summer - All Over 1000 KWH/month @ $0.0588 (June thru October ,
Winter - All Over 1000 KWH/month @ $0.0464 (November thru May ,
plus ECA & Tax.
COMMERCIAL - C1
Applicable to non -domestic power service where the maximiun 15-minute
interval integrated demand does not exceed 49 KW.

not less than 38 KW = $190.00, plus
Energy - First 20,000 KWH/month @ $0.049 , plus
Next 80,000 KWH/month @ $0.044 , plus
Next 100,000 KWH/month @ $0.040 , plus
All Over 200,000 KWH/month @ $0.039 , plus ECA & Tax.
SCHOOLS - M1
Applicable to public and private primary and secondary schools, regardless
of size of their electrical requirements.

ELEEMOSYNARY - M2
Applicable to churches and non-profit organizations who receive the majority
of their support from charitable contributions.

Lighting fixture, complete with mounting bracket, lamp, photoelectric control,
pole, wire, etc., is owned by the City. The following monthly rentals are
subject to additional charges for vandalism or abuse:

TEMPORARY OR SEASONAL SERVICE SURCHARGE
When Commercial or Industrial service is provided for a period of less than
one year continuously or is seasonal or temporary, a surcharge of twenty-
five percent (25%) shall be added to each month's bill, before applying Tax,
after the bill has been computed in accordance with the applicable rate
schedule. No monthly minimum or other charge is to be made during the
period that service is disconnected. For each non -recurring temporary
service where it is necessary for a temporary service pole to be set and/or
a temporary service drop to be installed from existing utility facilities,
the City may assess additional charges to recover the cost of installing
and removing such service.
SCHEDULE ECA
In addition to applicable base electric rates adopted above, a two-part
Energy Cost Adjustment shall be billed before Tax is applied each month.
The ECA factor to be billed shall be calculated in accordance with Section
Two and Section Three of this ordinance, which follows.
TAX
The 49/6 State Utilities Gross Receipts Tax is applicable to all rates except
City Use and agencies of the Federal Government; plus, 2.2% State License
Tax and/or other applicable taxes when levied by State or Federal Government.
Section Two. SCHEDULE ECA shall provide for annual and frequent fluctuations
in wholesale fuel adjustment charges and purchased power costs, annual
operation and maintenance costs, contributions to the General Fund in lieu of
taxes, and allowances for electric system extensions, improvements and
additions. All ECA factors shall be rounded -off to the nearest one -thousandth

Part A: Part A shall be calculated at 1000 KWH per month during Winter
and at 5000 KWH per month during Summer billing months according to the
following formula, but shall not be less than zero:
A = (APCo Rate FD + RSE + CNP + ECR) - (Fairhope R1 base x 1.0045)

Part B + C•• B shall be termed "Revenue Requlrernent Tractor" (RRF). The Revenue Require-
ment factor is the net revenue difference between the Electric 1'und's
Total Annual current, new or proposed revenue requirement (T) and the
Total Annual Test Period retail revenue (V) produced by base retail rates
shown in Section One, divided by Total test period Retail KWH sales (S):

C shall be termed "Fuel Cost Adjustment" (FCA). The Fuel Cost Adjustment
shall be calculated from the current month's wholesale power bills) as
follows:

where:
F = Supplier Wholesale Fuel Cost billed for current month.
P = Total KWH Purchases (All Suppliers) for current month.
L = Lag and Losses = 12% of P. The percentage of P is to be
reviewed periodically and revised when
and if required.
Part A may not be waived unless the City Council officially approves
such waiver for a specified period, not to exceed six months; such
waiver duly entered into the Council minutes along with valid reason(s)
for the waiver.
In the event Part A exceeds Part B+C, the ECA factor shall not exceed
Part B+C. In the event Part A is waived, Part B+C shall not be waived.
In the event Part B+C results in a negative factor, such negative ECA
factor shall be applied to each customer's monthly bill.
Section Three. Definitions:
Supplier Base Purchases: Total Annual Test Period wholesale charges by
Alabama Power Co., Southeastern Power Administration and/or Alabama Municipal
Electric Authority for the Demand and Energy components only. Part B.
Supplier Fuel Adjustment Char es: Monthly fuel adjustment charges by APCo,
SEPA and/or AMEA. This total monthly fuel adjustment chaxge is equal to "F"
in Schedule ECA paxt C. Wholesale fuel adjustment refunds from a previous
period may be used to reduce the revenue requirement for the current fiscal
year in paxt B, while fuel adjustment true -up charges from a prior period
shall increase the revenue requirement in paxt B.
Retail KWH Sales: Total Annual Test Period KWH sales (S) recorded by the City
to residential customers, schools,churches, non-profit organizations,
commercial and industrial customers, City Water and Sewer accounts and
estimated security light consumption. Sales recorded by the City as sales to
various City departments and facilities, except the Water and Sewer Department,
shall be excluded from retail KWH sales.

Revenue Requirement: Total Annual Rate Base required to cover all costs
reasonably expected to be incurred during the current fiscal year or the
next 12 months immediately following the test period or the effective date
of the new wholesale rate increases or decreases, plus an amount which
provides a reasonably adequate rate of return to cover electric system
improvements, additions and extensions. Wholesale rate and fuel adjustment
refunds may be used to decrease the revenue requirement for the fiscal year
during which the refund is received, only. Conversely, fuel adjustment
charges for prior periods shall increase the revenue requirement.
Test Period: For purposes of part B, Revenue Requirement Factor, of
Schedule ECA, the test period shall consist of 12 calendar months of the
latest fiscal year or any other typical and current 12 month period for
which complete purchase, sales and cost data is readily available.
Lam: The non -synchronous time relationship between time of wholesale
billing for purchases and the reconciliation of those purchases through
retail and City Use billing.
Losses and Unaccounted For: That electric energy and load which is lost due
to theft, inaccurate metering and billing, losses inherent in the electrical
system and equipment, and that electric energy which has been used by
consumers but for which an accounting or bill has not been rendered at the
time of test period reconciliation.
Section Four. GENERAL RULES AND REGULATIONS.
Payment: Bills are payable within ten (10) days from due date and, if
not paid within such period, may be increased as determined by the
Mayor and Council.
Service and Metering: Service to more than one premises shall not be
combined, nor shall it be shared with or resold to others. Any
customer receiving service at two different voltages or metering
points will be considered as two separate customers for billing
purposes. The type and location of metering is to be specified by the
City. The rates shown in Section One contemplate City ownership of
transformation and security light, facilities; however, rental or
ownership of transformation by an industrial customer is subject to
negotiation by and with the City.
Section Five. This ordinance shall take effect as of the -!� U /D 1984 Utility Billing Cycle after due adoption and publication required by law.
