AN ORDINANCE TO AMEND SECTION 10-7(b) OF THE CODE OF
ORDINANCES, CITY OF FAIRHOPE, ALABAMA BY THE INCREASING OF
THE MAXIMUM FINES AND IMPRISONMENT AS PROVIDED BY THE LAWS
OF THE STATE OF ALABAMA.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA, AS FOLLOWS:
Section 10-7(b) is hereby amended to read as follows:
(b) The Muncipal Judge shall have the authority to
punish any person convicting of violating any Municipal
Ordinance with a fine of not more that five hundred
dollars ($500.00) and/or a sentence of imprisonment or hard
labor for a period not exceeding six (6) months, except,
however, wherein the laws of the State of Alabama shall
provide for a greater fine and/or a greater sentence of
imprisonment or hard labor then the greater fine and/or
sentence of imprisonment or hard labor is hereby adopted,
whether now existing or hereafter enacted; provided,
however, that no fine or sentence of imprisonment shall
exceed the maximum fine or sentence provided by the City
Ordinance violated nor shall the fine or sentence exceed the
maximum fine or sentence provided for violation of a
substantially similar offense under State law. The penalty
imposed on a Corporation shall consist of the fine only plus
cost of court.

This Ordinance shall take effect immediately upon due
adoption and publication as required by law.
