HomeMy WebLinkAboutO-711A M11 ORDINANCE NO. 711 AN ORDINANCE AUTHORIZING THE SALE OF LEASEHOLD AND IMPROVEMENTS OWNED BY THE CITY OF FAIRHOPE, ALABAMA, AND AUTHORIZING THE MAYOR TO EXECUTE A BILL OF SALE CONVEYING THE LEASEHOLD AND IMPROVEMENTS OWNED BY THE CITY OF FAIRHOPE, ALABAMA, TO FARMERS AND MERCHANTS BANK, A BANKING CORPORATION. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA' FOLLOWS: ECTION ONE: It is hereby determined by the Council of the City f Fairhope, Alabama, that a certain leasehold interest and improve• ents thereon as hereinafter described, are not needed for public r municipal purposes. SECTION TWO: The Mayor of the City of Fairhope, Alabama, is zereby authorized to execute a.Bill of Sale vesting the FARMERS kND MERCHANTS BANK, a banking corporation, with the title of the nunicipality in and to the leasehold interest and the improvements :hereon situated in the City of Fairhope, Baldwin County, Alabama, described as follows, to wit: The East 65 met of Lot 4 and the West 2 feet of Lot 5, Block 7, Division 1 of the land of lessor in the City of Fairhope, Alabama, as per its plat thereof filed for record September 13, 1911, Miscellaneous Book 1, pages 320-21, Probate Records Baldwin County, Alabama. Frac'l Section 18, T6S, R2E, Baldwin County, Alabama, less the North 60 feet of the within described leasehold. SUBJECT, HOWEVER, to an agreement for the use of the West 9 feet of the remainder of the within described leasehold for ingress and egress to public parking facility. SECTION THREE: This Ordinance shall take effect upon its adoption and publication as required by law. ADOPTED THIS 28 DAY OF March , 1983. kttest lyn/,P. Phillips, City erk 4/13/83 On the instructions of City Attorney Jim Reid, Ord. No. 711, originally published on 31 March 1983, was republished on 4/18/83 with a corrected legal description. The original publication contained an error in the legal description which had been provided to the Attorney by the Fairhope Single Tax Colony. On discovering the slight error, the FSTC notified Attorney Reid with the resultant republication.
