HomeMy WebLinkAboutO-700ORDINANCE NO. 0 D AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF FAIRHOPE, ALABAMA, BE AMENDED BY REVISION OF SECTION 21-61 BY THE ADOPTION OF THE FOLLOWING BASE RATES FOR ALL GAS CUSTOMERS'WITHIN THE CITY LIMITS, AND ALL GAs CUSTOMERS OUTSIDE THE CITY LIMIITB, OF THE CITY OF FAIRHOPE, ALABAMA; AND TO DESIGNATE EACH CLASS OF CUSTOMER THERET-N. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the following rate designations, and rates, for all gas customers of the City of Fairhope are hereby established: SECTION 1. GR ERAL SERVICE WITHIN CITY LIMITS - G1 Applicable to individual dwellings and apartments, municipal and school buildings, and small individual commercial establishments whose physical location is within the corporate limits. MONTHLY RATE: First 300 cu.ft. or less for $3.90 (Minimum), plus Next 1000 tuft. or less @ $0.87 per 100 cu.ft., plus Next 8700 tuft. or less @ $0.72 per 100 cu.ft., plus Next 90,000 cu.ft. or less .@ $0.67 per 100 cu.ft., plus All over 1009000 cu.ft. @ $0.65 per 100 cu.ft., plus tax. SECTION 2. GENERAL SERVICE OUTSIDE CITY LMTS - G2 Applicable to individual family dwellings and apartments, school buildings and small commercial establishments whose physical location is outside the corporate limits. MONTHLY RATE: First 300 cu.ft. or less for $4.80 (Minimum), plus Next 1,000 cu.ft. or less @ $0.94 per 100 cu.ft., plus Next 8,700 cu.ft. or less @ $0.74 per 100 cu.ft., plus Next 90,000 cu.ft. or less @ $0.69 per 100 cu.ft., plus All over 100,000 cu.ft. . @ $0.66 per 100 cu.ft., plus tax. SECTION 3. INSIDE LARGE COMMERCIAL & INDUSTRIAL RATE - G3 Applicable to large commercial and industrial customers whose median monthly consumption is 100 Mcf or more on an interruptable basis, and whose physical location is within the corporate limits. MONTHLY RATE: First 20,000 cu.ft. or less for $142.00 (Minimum), plus " Next 80,000 cu.ft. or less @ $ 0.67 per 100 cu.ft., plus Next 900,000 cu.ft. or less @ $ 0.65 per 100 cu.ft., plus lo All over 1000,000 cu.ft. @ $ 0.62 per 100 cu.ft., plus tax. SECTION 4. OUTSIDE LARGE COMMERCIAL & INDUSTRIAL RATE - G!} Applicable to large commercial and industrial customers whose median monthly consumption is 100 Mcf or more on an interruptable basis, and whose physical location is outside the corporate limits. MONTHLY RATE: First 20,000 cu.ft. or less for $146.00 (Minimum), plus Next 80,000 cu.ft. or less @ $ 0.69 per 100 cu.ft., plus Next 900,000 cu.ft. or less @ $ 0.66 per 100 cu.ft., plus All over 1,000,000 cu.ft. @ $ 0.63 per 100 cu.ft., plus tax N0. 6 o ,page 2 SECTION 5. SPECIAL WHOLESALE RATE TO TOWN OF DAPHNE, ALABAMA - G5 The rates charged the Town of Daphne shall be as per that certain section entitled "SPECIAL WHOLESALE RATE TO DAPHNE G5 of the January 26, 1981, Gas Study prepared by St.John Engineers, Inc. as though set out fully herein; except, the Monthly rate is hereby revised as follows: Total Daphne Purchases x (United Rate + $0.52) SECTION 6. CITY OF FAIRHOPE USE Rates for the City shall be the above set out G1, General Service within City Limits rates. SECTION 7. AIR CONDITIONING CREDIT When a customer uses gas in central gas fired air conditioning equipment for cooling the premises, the customer's monthly bill shall be reduced by five cents (50) per hundred cubic feet (Ccf) for all volume purchases during the billing months of June through October; provided, however, that the customer's,total monthly volume exceeds 5,000 cu.ft. A customer must request the air conditioning credit and submit to a physical ii%spec- tion and approval of the air conditioning equipment by the Gas Superin- tendant before receiving such credit. SECTION 8. GENERAL RULES AND REGULATIONS (a),The above rates are those charged by the City and any additional charges levied by State or Federal authorities, such as the )4% State Utilities Tax, shall be in addition to said rates. (b) Bills are payable within ten days from due date and, if not paid within such period, may be increased by an amount to be determined 'by the City,Council. (c) If service is suspended, a reconnection fee will be charged as follows: G1 and G3 Inside) Customers -- $24-00 .G2 and G4 Outside) Customers - $30,00 (d) Retail service to more than one premises (unless served through one meter ) shall not be combined, nor shall it be shared with or resold to others. (e) In the event the supply of natural gas to the City is curtailed or if the total supply -is inadequate, only high -priority customers shall continue to receive service in accordance with the City's curtailment. plan. A high -priority customer includes uses of gas in a residence, small commercial establishment, school, hospital or similar institution, or any use where curtailment would endanger life, health, welfare, or maintenance of physical property due to the unavailability of an alternate energy supply. (f) Normal service and delivery pressure to the customer shall be deter- mined by the pressure available in the City's mains at the customer's location and may be reduced as necessary by the City to comply with supplier and regulatiry curtailment directives under the current Modified IV Category Plan. Where the customer's normal operational pressure requirements exceed the delivery pressure available, thus requiring the installation of incr- eased compressor capacity, a pressure factor (corresponding to the PSIG) will be used to calculate the actual ponthly consumption to be billed. r-- NO. 960 rpage 3 JK (g) In the event a Maximum Daily Quantity (MDG) overrun penalty is levied against the City due, in part or in whole, to industrial delivery over -runs, the industry will pay a daily over -run penalty of $1.00 per hundred cubic feet against all units in excess of the industry's established MDG in addition to the established rate. SECTION 9. GAS RATE ADJUSTMENTS The foregoing retail rate schedules (G1, G2, G31 G4) shall be subject to adjustment, upon concurrence of the Mayor and City Clerk, according to fluctuations in natural gas purchase and delivery costs and annual revenue requirements of the City of Fairhope. Adjustments to the base retail rate schedules listed above shall be performed, in the absence of of a formal rate hearing, in accordance with either one or both of the formulas set out below. A formal rate hearing shall be held least once every two years, or in the event that total adjustments to the base retail rate schedules reach or exceed twenty cents (20¢) per hundred cubic feet, to review and adjust the Base Retail Rates above, and also the adjustment formulas as required. (a) Gas Cost Adjustment (GCA`)�� GCA = [(TP x FR) - (DP x FR11 - C(TP x $4.80)-(DP x $4.801 RS where : DP is -equal to total,.Annual Daphne purchases from the City of Fairhope for resale in MCF. FR is the new or proposed wholesale rate TP is equal to the total anual Fairhope purchases in MCF from United Pipe Line Co. RS is total annual Fairhope Retail Sales, excluding City Use, in Ccf. (b) Revenue Requirement Adjustment (RRA) RRA = (EO $403,500) + (EG - $310,000)- Refunds (optional) RS where: EG is new or budgeted Annual Contributions to the Fairhope General Fund. EO is estimated or budgeted Annual Operation and Maintenance Costs for the next twelve months RS is total annual Fairhope .retail sales, excluding City use, in Ccf. SECTION 10. If any part of this Ordinance shall be rated unconstitutional or void by a court of competent jurisdiction, then all other parts or sections herein shall remain in full force and effect. SECTION 11. All ordinances.in conflict herewith be and the same are hereby repealed. SECTION 12.
