HomeMy WebLinkAboutO-685ORDINANCE NO. AN ORDINANCE PERTAINING TO THE REGULATION OF BURGLAR ALARM SYSTEMS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, AS FOLLOWS: SECTION ONE: Every person, firm, or corporation, who shall install a burglar alarm system in the City of Fairhope or the police jurisdiction thereof, shall first obtain a permit therefor as is herein required from the authorized Building Official of the City of Fairhope. All applications for such permits shall state thereon the name of the property owner and the address of the property where the system shall be installed, the name of the installer, who shall be certified and licensed by the City of Fairhope for such installation, the type of system to be installed and a statement that the owner is aware of the responsibilities imposed by this ordinance. SECTION TWO: For each permit issued in accordance with this ordinance, where a burglar alarm system is to be monitored by the Fairhope Police Department, a connection fee of $25.00 shall be paid to the Fairhope City Clerk. An additional monthly charge of $5.00 shall be paid by the owner of each system to the Fairhope City Clerk, for each continuing connection, including connections installed prior to the enactment of this Ordinance, it being the purpose of this continuing connection fee to defray the expense of the space and facility use at the termination point. SECTION THREE: Any person, firm or corporation having a burglar alarm system, monitored by the Fairhope Police Department, shall pay an additional fee, according to the following schedule: (a) No additional fee for the first two false alarms; (b) Ten ($10.00) Dollars for the third false alarm; (c) Fifteen ($15.00) Dollars for the fourth false alarm; (d) Twenty ($20.00) Dollars for the fifth false alarm; (e) Twenty -Five ($25.00) Dollars for the sixth false alarm and each alarm thereafter during any calendar month. No charge shall be made for the testing of the installed connection where prior notification has been given to the Fairhope Police Department. SECTION FOUR: Subscribers of the burglar alarm monitoring service, provided for herein, shall pay the charges accrued for the previous month to the Fairhope City Clerk on or before ten (10) days following the date of billing through the utility billing system. 1 SECTION FIVE It shall be unlawful for any person, firm or corporation to make or cause or permit to be made or caused, upon any premises occupied or controlled by him, any loud and unnecessary noise or sound emitted from an audible burglar alarm system shich is physically annoying to persons or which is so harsh or so prolonged in its use, time and place as to occasion physical discomfort, or which is injurious to the health, peace, comfort, privacy or tranquility of the inhabitants of the city or to any one of them. It shall be considered a violation of this ordinance for an audible burglar alarm system to emit a sound, otherwise herein -2- prohibited, for a time longer than two consecutive minutes or for such other length of time as may be prescribed by written agreement with the Fairhope Police Chief. This provision shall apply to audible burglar alarm systems whether now or hereafter installed. SECTION SIX: Any person, firm or corporation who shall violate the provisions of this ordinance shall be subject to a fine in an amount not to exceed $500.00 or imprisonment in the city jail not to exceed six (6) months or to both such fine and imprisonment, in the discretion of the Court trying the case. SECTION SEVEN: If any Section, sentence, paragraph, clause, phrase or word of this Ordinance is for any reason held or declared to be unconstitutional, inoperative or void, by a Court of competent jurisdiction, such holding or invalidity shall not affect the remaining portions; and the remainder of this Ordinance shall be deemed and held to be valid. SECTION EIGHT: EFFECTIVE DATE. This Ordinance shall take effect upon its due adoption and publication as required by law, provided, however, all provisions herein pertaining to audible alarms shall not become effective until sixty (60) days after the date of first publication.
