ORDINANCE NO. 1774
WHEREAS , JAMES EDWARD SMITH AND MARGARET BALLARD SMITH, the
owners of the hereinafter described property, did, in writing, petition the City of Fairhope, a
municipal corporation, for annexation under Section 11-42-21 of the Code of Alabama, 1975 , as
amended ; and
WHEREAS, a map of said property 1s attached to said Petition as an exhibit; NOW,
THEREFORE
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF FAIRHOPE,
ALABAMA, that the following described property , lying contiguous to the corporate limits of
the City of Fairhope, Alabama ; and not within the corporate limits or the police jurisdiction of
any other mun icipality ; be and the same is hereby annexed to the City of Fairhope, Alabama, to-
wit:
Property is located east of Onyx Lane and north ofLongleafLane, Fairhope, Alabama.
LEGAL DESCRIPTION:
PART OF PPIN # 82432
Commencing at a 1 1/2 " OP EN TOP PIPE AT THE SE CORNER OF THE SW 1/4 OF
SECTION 23, TOWNSHIP 6 SOUTH , RANGE 2 EAST BALDWIN COUNTY, AL ;
thence N 89°47'37"W, along the South line of said Section a distance of940.64 feet to a
SET 5/8" CAPPED REBAR to the POINT OF BEGINNING ; thence N 89°47'21 "W ,
along said South line a distance of 64.40 feet to a 1/2 " CAPPED REBAR "GEO"; thence
N00 °19 '53 "E , a distance of676.15 feet to a 1/2" CAPPED REBAR "GEO"; on the agreed
upon boundary one between the Smiths and Firethome Tract ; thence N89 °55 '25"E , along
said line a distance of64.40 feet to a SET 5/8" CAPPED REBAR; thence S00 °19 '53 "W, a
di stance of 676.47 feet to the POINT OF BEGINNING, said parcel containing 1.00 acres ,
more or less.
This property shall be zoned R-1 , Low Density Single-Family Residential District.
BE IT FURTHER ORDAINED that a certified copy of this Ordinance, with a copy of the
Petition and the exhibit, be recorded in the Office of the Probate Judge, Baldwin County,
Alab a ma.
This Ordinance shall take effect immediately upon its due adoption and publication as required
by law .

attached EXHIBIT A , such property being without the Corporate Limits of the City of Fairhope,
Alabama, but being contiguous to th e said Corporate Limits; and such property not lying within
the corporate limits or police jurisdiction of any other municipality , do , by these presents, hereby
petition the City of Fairhope , a muni c ipal corporation, that said property be annexed into the City
of Fairhope , Alabama .
The subject land is delineated on the map attached hereto as EXHIBIT B that will be prepared by
the City of Fairhope to verify property is contiguous .
This petition is filed under authority of Section 11-42-21 , Code of Alabama, 1975 , as amended .
