HomeMy WebLinkAboutO-663ORDINANCE NO. 663 AN ORDINANCE AMENDING ORDINANCE NO. 662 OF THE CITY OF FAIRHOPE, ALABAMA, PERTAINING TO DEALING IN USED OR SECONDHAND GOLD, SILVER, COINS, PRECIOUS METALS, PRECIOUS GEMS, ETC. IBE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, AS FOLLOWS: That Ordinance No. 662 be the same as hereby amended by adding the following sections: SECTION EIGHTEEN: RECORDS to be kept by ALL PERSONS, FIRMS, AND CORPORATIONS dealing in used or secondhand Gold, Silver, or other precious metals; diamonds, other precious stones and gems; coins, whether foreign or domestic; jewelry, or any other article of like kind: (a) Every person, firm, or corporation who shall buy or sell, or both, the above described items shall keep a book in which shall be entered promptly at the time of purchase a brief description of the items purchased, the date and hour of the purchase, and a brief description of the person from whom the purchase is made together with the name and address of such person. (b) Each transaction shall be serially numbered on the book at the time of making the entry. An identifying tag or label numberec to correspond with the transaction entry number shall be attached or placed on the article purchased; except that small articles bought in bulk too numerous to conveniently tag or mark individ- ually may be marked by placing the tag or mark on the container or wrapper in which the articles are kept or placed. (c) Every person, firm, or corporation shall, on every day except Sunday, before the hour of 10:00 a.m., deliver to the Chief of Police or his designated agent, a legible transcript of the business done during the business day immediately preceding the filing of the transcript. The report on Monday of each week shall cover the transactions of Saturday and Sunday. (d) An original supply of one record book and ten daily report forms shall be furnished by the Police Department of the City of Fairhope, and these items will be the only authorized method of compliance with (a) and (c) above. Replacement supplies, and (ORDINANCE NO. 663 Page 2 identifying items in (b)) shall be the responsibility of the dealer. Method of compliance to (b) subject to the approval of the Chief of Police or his designated agent. SECTION NINETEEN: REGISTRATION OF DEALERS Every person, firm, or corporation dealing in the articles described in the prior section herein shall promptly, at the beginning of business or immediately upon adoption of this Ordi- nance, register with the Chief of Police, in a book kept for that purpose, his name, address, and every place where he carries on business or stores property. SECTION TWENTY: TIME ARTICLES TO BE HELD AFTER PURCHASE No property of the kind described in this Ordinance or Ordinance No. 662, which this Ordinance amends, shall be sold, traded, bartered, smelted, crushed or otherwise altered in appear- ance, or transported or stored until forty-eight (48) hours after the Dealer has submitted his daily report as required in Section 18 (c) herein; unless permission for such sale or action is obtained in writing from the Chief of Police. SECTION TWENTY-ONE::INSPECTION OF RECORDS Books and records kept by each dealer described in Ordinancc INo. 662, or in this Ordinance, shall be open for inspection by the Chief of Police or by any officer of the Police Department of the City of Fairhope at all times and the dealer and his agents and employees shall at all times exhibit the records to such officers Ion request. SECTION TWENTY-TWO: APPLICATION AND VIOLATIONS The provisions of this Ordinance and Ordinance No. 662, which this Ordinance amends, shall apply to and be binding upon every employee or agent of the dealer described, and it shall be an offense against the City for any dealer or his agents, servants; officers, or employees to fail or refuse to carry out the provision of this Ordinance or Ordinance No. 662. Any person who shall �s RDINANCE NO. 663 Page 3 violate the provisions of this Ordinance, or Ordinance No. 662, shall be subject to a fine in an amount not to exceed $500.00 or imprisonment in the City Jail not to exceed six (6) months, or to both such fine and imprisonment, in the discretion of the Court trying the case. SECTION TWENTY-THREE: If any Section, sentence, paragraph, clause, phrase or word of this Ordinance is for any reason held cr declared to be unconstitutional, inoperative or void, by a .ourt of competent jurisdiction, such holding or invalidity shall not affect the remaining portions; and the remainder of this Ordi shall be deemed and held to be valid. SECTION TWENTY-FOUR: EFFECTIVE DATE This Ordinance shall take effect immediately upon its due idoption and publication as required by law. ADOPTED THIS 22 DAY OF December 1980 J v� r,
