ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 557, ADOPTED
11 AUGUST 1975, KNOWN AS THE ZONING ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL, CITY OF FAIRHOPE, as
follows: The Ordinance commonly known as the Zoning Ordinance
adopted 11 August 1975 together with the Zoning Map of the City of
Fairhope be and the same hereby is changed and altered in respect
to that certain property described as follows:
Lands of the Fairhope Single Tax Corporation lying in Blocks 2,
3, and 15 of Division 4, as per plat thereof filed for record
13 September 1911 in Misc. Book 1 at pages 320-321, Baldwin
County, Alabama, individual leaseholds being mre particularly
described as follows:(all in Section 17, T6S, R2E)
(a) Duncan Turnbull: Lots 7 & 8, Block 3;
(b) Ed Roberts: Lot 5, Block 2;
(c) David Stapleton: Lot 6 and the south half of Lot 7, Block 2;
(d) Ella J. Creamer: The east 10 feet of Lot 1, the east 10 feet
of the north half of Lot 2, the north half of Lot 7 and all
of Lot 8, Block 2;
(e) F.H. Houtkamp: Lot 1, Block 15, being the north 66 feet of
west 132 feet of said Block 15 after allowing for the extension
of Oak Street & Bancroft Street;
(f) Irene Pierce: Lot 2, Block 15;
(g) Gene Fuqua: Lots 3 and 4, Block 15;
(h) A.W. Hughes: Lots 5 and 6, Block 15;
(i) Etta Pedneau:From the northeast corner of Block 15, Division
4 of the lands of the FSTC, running south 33 ft. and east
33 ft. to the southeast corner of the intersection of Ban-
croft St. as presently extended and of Oak St. as presently
extended between Blocks 15 & 16, thence east along south side
of Oak St. 132 ft. to point of beginning, thence south 132 ft.
to a point and east 132 ft. to the City Park, thence north
43 ft. and nortrnaestwardly 102.98 ft. to south si.dC of Oak
St. and west 80.2 ft. to point of begirming,designated on
lessor's unrecorded re -subdivision of said Block 15 as Lots
7 and 8.
The classification of said property is hereby changed from
R2 Medium Density SF Residential to B4 Business & Professional
Offices and it shall hereafter be lawful to construct on such
property any structures permitted by Ord. No. 557 and to use said
premises for any use permitted by the terms of Ord. No. 557; pro-
vided, however, that the plans for any structure or building sough
to be erected on said property shall be in compliance with the
building laws of the City of Fairhope and that any structure shall
be approved by the Building Official of the City and that any such
structure be erected only in compliance with such laws, including
the requirements of Ord. No. 557.
