AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED PROPERTY
,THICH SAID PROPERTY IS CONTIGUOUS TO THE CITY LIMITS OF THE
CITY OF FAIRHOPE, ALABAMA, SUCH ANNEX BY PETITION OF ALL OF
EHE PROPERTY OTANERS OF SAID PROPERTY
WHEREAS, John V. Duck, and wife, Betty W. Duck, are the
rs of fee simple of the hereinafter described property
id by Petition, petition the City of Fairhope, Alabama, a
.unicipal corporation, for annexation under Act 2228, adopted
n the 1971 Regular Session of the Legislature of the State
f Alabama, and
WHEREAS, a map of said parcel of said property is attached
o said Petition.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
ity of Fairhope, Alabama, by theses presents do hereby annex
11 of the hereinafter described property, which is contiguous
o the corporate limits of the City of Fairhope, Alabama and
ore particularly described as .follows, to -wit:
From the Southeast corner of Section Twenty-four, Township
Six South, Range One East, run North 3379.5 feet; thence
run East 328.5 feet to an iron pipe at the Northeast corner
of property formerly belonging to Wilmer C. Davis, which
point is the Southeast corner of property of Olivet J. Powers;
thence run N 09°58'E, along the Western, mri— in of the riQrt-
of-way of Eastern Shore Blvd. (Now U.S., Highway 98, scenic, route)
50 feet to the Northeast corner of the Olivet J. Powers lot,
which point is the Southeast corner of the William Davis, Jr.
Lot herein described for a POINT OF BEGINNING: Thence run
N 09°58'E along said Highway No. 98, 93.1 feet to a fence
corner; thence run, following the North fence line enclosing
the William Davis, Jr. Lot, N65°12'W, 218 feet; N 62°34' W,
85.3 feet; N 63°48' W, 322.6 feet to a point at approximate
mean Flood Tide level on the Eastern margin of i4obileBay;
thence run S 29' 30' W, 92 feet to a point on the North line
of the said Olivet J. Powers lot; thence run S 63' 30'E,
650 feet to the Point of Beginning; including all lands lying
between the North and South boundaries of the property herein
described, extended to Mobile Bay, together with all littoral
or riparian rights thereto belonging or pertaining. Lot
contains 1.5 acres, more or less, and lies in Section 24,
Township 6 South, Rang 1 East, and partly in Section 19,
Township 6 South, Range 2 East, Baldwin County, Alabama, and
is a part of that certain property conveyed to William Davis,
Jr. by William Davis and Eloise Davis, his wife, dated
February 17, 1904, and recorded in Deed Book 7, at Page 82,
Probate Records of Baldwin County, Alabama.
BE IT FURTHER ORDAINED by the City of Fairhope, Alabama, that the
(City does by these presents assent to the said annexation to the
City of Fairhope of the hereinabove described property.

BE IT FURTHER ORDAINED by the City of Fairhope, Alabama,
that a Certified copy of this Ordinance, along with the Peition
of Annexation and the map *attached thereto be recorded in the
f.fice of the Judge of Probate of Baldwin County, Alabama.
THIS ORDINANCE shall take effect immediately upon its due
adoption and publication as required by law.

Comes now JOHN V. DUCK and wife, BETTY W. DUCK, being the
property owners of the hereinafter described property, such
property being without the corporate limits of the City of
Fairhope, Alabama, but being contiguous to the corporate limits
of the City of Fairhope, and such property not lying within the
corporate limits of police jurisdiction of any other municipality,
do by these presents hereby Petition the City of Fairhope, Alabama,
a municipal corporation , to annex said property into the City
of Fairhope, Alabama.
A map of said property is attached hereto and made a part
is though fully set out herein.
This Petition is filed under authority of Act No. 2228,
1971 Acts of the State Legislature of the State of Alabama, and
the property being more particularly described as follows,to-wit:
From the Southeast corner of Section Twenty-four, Township
Six South, Range One East, run North 3379.5 feet; thence

Range 2 East, Baldwin County, Alabama, and is a part of that
certain property conveyed to William Davis, Jr. by William
Davis and Eloise Davis, his wife, dated'February 17, 1904,
