The City Council met in a Work Session
at 4:41 p .m., Fairhope Municipal Complex Council Chamber,
161 North Section Street, Fairhope, Alabama 36532,
on Monday, 27 February 2023 .
Present were Council President Jay Robinson, Councilmembers: Corey Martin,
and Jimmy Conyers; Mayor Sherry Sullivan, City Attorney Marcus E. McDowell and
Assistant City Clerk Jenny Opal Wilson. Councilmember Jack Burrell , Councilmember
Kevin Boone, and City Clerk Lisa A. Hanks were absent.
Council President Jay Robinson called the meeting to order at 4:41 p.m. and
apologized for starting the meeting late and appreciate your patience.
Council Presi dent Robinson moved forward to Item No. 1 the "Discussion of
Old Substation at Young St. and Nichols St." by Dr. Lynn E. Yonge. Council President
Robinson asked Dr. Yonge to come forward for presentation. Dr. Yonge presented two
handouts to Council of a diagram of artwork by Bruce Larsen and an article on an
architecture concept in Seattle. He discussed the substation is retiring and proposed a
small park. Transformers could be taken down and leave the framework for the
potential sculpture in diagram and build a pavilion. Dr. Yonge referenced the City of
Seattle in article. We could recognize concept and use art that fits Fairhope's history
in this area as Black African American and make beautiful with classic landscaping
with businesses across the street. We can take time to build . Do not destroy thi s
structure and gather ideas. Dr.Yonge is willing to contribute personally and find others
to support. We can prevent climbing of the structure for safety. Dr. Yonge was open
for comments.
Councilmember Martin liked the concept with public park. He asked Dr. Yonge
to contact him for further discussion.
Councilmember Conyers thank Dr. Yonge and commented on his creativity. He
additionally inquired on fiber in the building .
Mayor Sullivan discussed property would be a walkable park for community.
We are not touching the steel structures until directed by Council.
Council President Robinson asked Dr. Yonge what exactly you are asking from
the City . Lets not tear it down and be open minded, look at cost, and donation of
artwork. We have volunteers and the City to support. Council President Robinson and
councilmembers thanked Dr. Yonge.

Council President Robinson moved forward to Item No. 2 the "Discussion of
Litter Trap Grant". Richard Johnson Public Works Director came forward for
discussion and addressed the specifics of the ADEM grant opportunity at 100% for the
2023 GO MESA Litter Trap Fund for Liter Abatement. Mr. Johnson acknowledged Ms .
Kim Burmeister on her work in preparing the handout that is within the Council Packet.
Council President Robinson was in favor of the grant at 100%. Councilmember Martin
inquired on the grant covering 100% of the City's request for $168 ,675.00. Mr. Johnson
replied the $168,675,00 in total would cover grant funding of design, fabrication and
installation of twelve (12) litter interceptors for three (3) years of maintenance, service,
and reporting. Council President Robinson thanked Mr. Johnson.
Council President Robinson moved forward to Item No. 3 on agenda
"Discussion of Cost of Services Study for Utilities". Mayor Sullivan came forward to
present. She commented we have not done a study within five (5) years. Typically
done within three (3) years. AMEA provides $25 ,000.00 in funding do to the electrical
services cost of study . The total is three (3) percent more than what we have paid in
the past for $75 ,000.00 for all three (3) utilities. We do not have in our budget. I wanted
to bring forward tonight to the Work Session for your opinion and to see if Council
would like to move forward with your feedback. Council President Robinson was in
favor to proceed. AMEA would cover $25 ,000 and the City would pay $50,000.00
unbudgeted. If we have not done in five (5) years , we should do every three (3) years .
I am in agreement. City Treasurer Kim Creech confirmed the study would take twelve
(12) to eighteen (18) months. She commented utilities would be split. Councilmember
Martin is glad were following up with and is in favor.
Council President Robinson moved forward to Item No . 4 on agenda
"Committee Updates".
Councilmember Martin discussed the Recreation Board has Item No . 13 on
agenda tonight. Recreation Board has interview process coming up soon with several
applicants wanting to join the Recreation Board. Councilmember Martin addressed
looking for candidates to work as a whole body where business can continue to flow in
all directions.
Councilmember Conyers had no update.
Council President Robinson gave brief update that he attended Arbor Day on
Saturday . The Tree Committee, the City, Mr. Richard Johnson, and Ms . Paige
Crawford did an awesome job on the event. They had a great tum out of people and
good weather.

Council President moved forward to Item No. 5 on agenda "Department Head
Updates".
Chief Chris Ellis discussed Item No. 11 and answered Council questions that
the City of Fairhope approves and adopts to include the use of a boat slip at the Fairhope
Docks as part of its agreement with the Fairhope Volunteer Fire Department for the
safety of the citizens of Fairhope and others in the fire jurisdiction and waives the
annual fee of $3,360.00 . Councilmember Martin asked for explanation on access to
the water for Fire Department. Chief Ellis discussed the twenty-five (25) ft. Boston
Whaler sits at Station 1 as needed to launch. When we get a call for water rescue or to
assist on water, we respond to station, hookup boat, and launch. A boat slip on water
will cut down on response time . Is there anything extra with Coast Guard. Chief Ellis
responded they will dispatch us for boaters in distress because we can get there quicker.
Coast Guard and Marine Police will assist as required. Martin inquired on liability.
Mayor Sullivan confinned coverage. Council President Robinson inquired on
availability of slip. Mayor Sullivan confirmed available. Councilmember Martin noted
we are waiving annual fee. Chief Ellis thanked Council.
Mr. Richard Johnson Public Works Director gave update they opened bids on
the K-1 Center. We received four (4) qualifying bids. The lowest bid was below with
a 20% contingency built in and below $70 ,000.00. Southern Earth Environmental
Company has worked with the low bidder Hernandez . Bid is certified today . We will
have on agenda in two (2) weeks. Councilmember Martin inquired if they were a
minority business . Mr. Johnson will look in to and report. Mr. Johnson additionally
discussed a joint grant application with the County on equipment for Solid Waste with
Memorandum of Understanding (MOU).
Mr. Johnson discussed Item No . 5 earlier in presentation and addressed
questions that the City Council authorizes submission of an application to ADEM
requesting a grant funded through GOMESA for additional litter abatement; and
authorizes the Mayor Sherry Sullivan to sign all necessary grant documents on behalf
of the City .
Mr. Johnson discussed Item No. 6 and addressed questions that the City of
Fairhope hereby terminates the contract titled Annual Contract for Fire Extinguisher
Inspection Services (Bid No. 23-008) between the City of Fairhope and Fire and Safety
Commodities, Inc. for Tennination for Convenience clause found in Standard Terms
and Conditions Item #6.b., Clause 57; and authorizes Mayor Sherry Sullivan to sign
the necessary paperwork. ·
Mr. Johnson discussed Item No . 8 and addressed questions that the City of
Fairhope approves the selection for (RFQ PS23-015) to hire a Professional Engineer
for Fairhope Municipal Pool Investigative Phase; and hereby authorizes Mayor Sherry
Sullivan to execute a contract with Watermark Design with a cost of $37,500.00.

Mr. Johnson discussed Item No. 10 and addressed questions that the City of
Fairhope approves the procurement of forty-four (44) loads of Washed Beach Sand to
replenish the sand at Magnolia Beach on Fairhope's waterfront with Hwy 27 Dirt , Inc .
with a total cost not-to-exceed $19 ,800.00. Mr. Johnson discussed potential grant
opportunity .
Councilmember Martin addressed a Recycling Facility in town. Mr. Johnson
responded Baldwin County has taken the lead with building facility at Magnolia. He
discussed process and cooperative agreement. Councilmember Martin inquired on
distance of travel. Mr. Johnson commented we will cut down on mileage from forty-
five (45) miles to twelve (12) miles in distance . Councilmember Martin inquired on
mixed use. Mr. Johnson replied mixed. Mr. Johnson discussed education and the
challenges. Council President Robinson thanked Mr. Johnson.
Ms. Paige Crawford , Director of Community Affairs gave update. Internally
we are doing housekeeping in the conclusion of Mardi Gras on parade rules ,
regulations , and permits internally with the Police Department and Public Works and
plan to bring to upcoming Work Session for discussion . Council President Robinson
thanked Ms. Crawford .
Mr. Ben Patterson discussed Item No. 12 and addressed questions that the City
Council approves the Compensation and Job Classification Plan along with the Grade
Order Sheet be amended and approved to fund (Lead Electrician -Grade 8) and defund
Licensed Electrician -Grade 11) positions in the Electric Department ; and the job
descriptions and grade of pay for same. Councilmember Martin inquired on license.
Mr. Patterson will hold license and over the lead . Council President Robinson thanked
Mr. Patterson.
Mr. Hunter Simmons , Planning Director discussed Comp Plan with City
working with County on projects with growth parallel with MPO and bike routes
countywide with jurisdictional lines. We are meeting with the County tomorrow .
Council President Robinson thanked Mr. Simmons.
Council President Robinson discussed Item No. 7 that Mayor Sherry Sullivan is
hereby authorized to execute a contract with TischlerBise, Inc. to perform Professional
Financial Con sulting Services to Study Update of Impact Fees (RFQ No. PS23-1 O);
with a not-to-exceed amount of $72 ,160.00. Mayor Sulli van commented Attorney
Chris William s can addres s questions.

Mayor Sullivan discussed Item No . 9 and addressed questions to Award (Bid
No. 23-015) to Jerry Pate Company for Irrigation Pump System Control Panel
Replacement for Quail Creek Golf Course with a total bid proposal not-to-exceed
$30 ,096.50.
There being no further business to come before the City Council , the meeting
was duly adjourned at 5:27 p.m . We will return for Council Meeting at 6 :00 p.m .

abatement funding?
Though Fairhope is by no means "trashy", we can improve our
litter program by capturing litter at some of the city's known hot
spots. Outreach (watershed signage) may also be included .
If awarded, this grant would supplement Fairhope's existing litter
program which includes street sweeping, litter pick up by Public
Works staff and the existing litter boom in the Winn Dixie pond off
Morphy Avenue .
MS4 (Fairhope's stormwater permit) requires Fairhope to have an
ever-evolving litter program and encourages monitoring and reporting
quantities of litter collected. This will help us achieve that goal.
This grant requires no matching funding from the City of Fairhope
The details of this proposal include staff being involved in grant
acquisition, coordination with the contractor and reporting.
If awarded, the contractor would provide installation, materials
and maintenance of all litter abatement devices . Furthermore, litter
collection will be conducted by the contractor at and around the
abatement site (within 100' of abatement site) and these amounts will
be included in the reporting and profiling of litter collected .
