ORDINANCE NO. 639
AN ORDINANCE TO PROVIDE FOR THE CITY OF FAIRHOPE, A MUNI-
CIPAL CORPORATION, TO USE ANY AND ALL METER DEPOSITS MADE BY
ANY UTILITY CUSTOMER OF THE CITY OF FAIRHOPE, TO APPLY TOWARD
ANY UNPAID BILL FOR UTILITIES IN ARREARS OVER SIXTY (60) DAYS
AFTER SAID CUSTOMER HAS BEEN DULY NOTIFIED BY A FINAL NOTICE
MAILED BY REGULAR MAIL TO THE LAST KNOWN MAILING ADDRESS OF
SAID UTILITY CUSTOMER; AND TO REQUIRE ANY UTILITY CUSTOMER,
WHETHER IT BE GAS, WATER OR ELECTRICITY, TO MAKE NEW DEPOSITS
WHEN ALL UNPAID BILLS HAVE BEEN PAID IN FULL AND REQUEST IS
MADE TO THE CITY FOR RECONNECTION AS A UTILITY CUSTOMER, WHETHER,
FOR WATER, GAS OR ELECTRICITY.
SECTION 1 - Any utility customer of the City of Fairhope,
Alabama, whether for water, gas or electricity, whose utility
bill is in arrears over sixty (60) days and when said customer
has been given due notice by mail, said notice to be mailed to
the last known mailing address of the utility customer, shall
have the utility customer's meter deposit applied toward the
unpaid bill, whether for gas, electricity and/or water.
SECTION 2 - If the said meter deposit is insufficient to
pay all of the final bill, the same shall remain due and payable
by said utility customer, for either electricity, gas or water,
and upon re -application by said customer, all arrearage and bill!
must be paid in full and new meter deposits for each utility
must be deposited with the City of Fairhope before the customer
shall be reconnected for either electricity, gas or water.
SECTION 3 - If any part or parts of this Ordinance shall
be declared unconstitutional by any court of competent juris-
diction, the remaining parts shall remain in full force and
effect.
SECTION 4 - This ordinance shall take effect upon its due
adoption and publication as required by law.
