AN ORDINANCE TO ESTABLISH FREE PUBLIC LIBRARIES; APPOINT
LIBRARY BOARDS: SET OUT THE POWERS AND DUTIES OF THE LIBRARY
BOARD: ESTABLISHMENT AND MAINTENANCE OF JOINT LIBRARY SERVICE
IN ACCORDANCE WITH TITLE 11-90-1 THROUGH 11-90-4 OF THE 1975
CODE OF ALABAMA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA

Section 1. That the CITY OF FAIRHOPE does hereby establish''.
a free public library, and to that end, may accept gifts, donations
and bequests of land, buildings or money therefor and may make
appropriations from the Municipal Treasury in support thereof
in such sums as the CITY COUNCIL may deem proper.
Section 2. LIBRARY BOARDS.
The City Council of the CITY OF FAIRHOPE hereby
establishes a Library Board consisting of five (5) members and
that the government and supervision of the said Library shall
be vested in said Board, and that the said Board shall be
appointed by the Mayor and City Council of the CITY OF FAIRHOPE,
Alabama.
Section 3. The terms of membership on the Library Board,
as first appointed, shall be as follows:
(a) One member shall be appointed for one year;
(b) The second member shall be appointed for two years;
(c) The Third member shall be appointed for three years;
(d) And two members shall be for four years.
Section 4. After the first term, all appointments to this
Library Board shall be for four (4) years.
Section 5. All vacancies shall be filled by the Mayor and
Council of the CITY OF FAIRHOPE, including expired and unexpired
terms.
Section 6. All members of the Library Board shall serve
without compensation.
Section 7. POWERS AND DuT'IES,
(a) The Library Board shall have full power and
authority to:
(1) Control the expenditure of all funds received or
appropriated for such Library;
(2) Erect or rent buildings to cost not in exceEs of }
the funds available to it; '
(3) To purchase books and equipment;
(4) To provide a system of library service to be made
easily available to all citizens of the CITY OF FAIRHOPE through
central Library, branches, stations, book truck service or other.{
appropriate means;
(5) Elect a librarian and other employees; and
(6) Manage and control the said library in order to
carry out the full intent and purpose of this chapter.
Section 8. A careful and complete record and set of books
shall be kept by the Library Board, showing the proceedings of
their several meetings and the receipts and disbursements in
detail of all funds.
Section 9. The Library Board shall have all further power..
as is conferred upon it by Section 11-90-4 of the 1975 Code of
Alabama insofar as it relates to contracting on behalf of the
local Library Board, to and with the library board of other
political units or govenmental agencies or instrumentality with
respect to establishment or maintenance of joint library service
upon such terms as may be agreed upon by the several contracting
parties.
Section 10. The Library Board of the CITY OF FAIRHOPE,
acting jointly with other library boards that it shall contract
with, shall have the power to cooperate with all state and
federal agencies and institutions in furtherance of the purpose
of this chapter, and all municipal, county and joint library
boards shall, from time to time, submit such records and reports
as may be required by the public library service; provided, that
nothing in this Section shall be so construed as to infringe
upon any municipal charter provisions governing the administrati
of existing free public libraries.

Section 11. That if any part of parts of this Ordinance
shall be declared unconstitutional by any court of competent
jurisdiction, all remaining parts shall remain in full force
and effect.
Section 12. That this Ordinance shall take effect ur '}
