HomeMy WebLinkAboutO-635V ORDINANCE NO. 635 AN ORDINANCE TO ESTABLISH GAS RATES FOR THE TOWN OF DAPHNE, ALABAMA, WHEN THE TOWN OF DAPHNE, ALABAMA EXCEEDS ITS TOTAL ALLOCATION OF GAS OF TEN PERCENT AS METERED AT THE MAIN METERING STATION OF THE CITY OF FAIRHOPE, ALABAMA SOUTH OF BAY MINETTE FROM UNITED GAS SUPPLY COMPANY FROM THE PRESENT RATE TO G-4 INDUSTRIAL RATES AND FURTHER, TO ESTABLISH THE PENALTIES AS ESTABLISHED BY THE F.E.R.0 UNDER CURTAILMENT PLAN TO THE SUPPLIER OF NATURAL GAS TO THE CITY OF FAIRHOPE, ALABAMA TO UNITED GAS PIPELINE COMPANY. T BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA a1 SECTION 1: That the City of Fairhope, Alabama hereby establishes the costs of the gas that it sells to Daphne, Alaba. from its present rate to G-4, Industrial Rate, when the Town of Daphne exceeds its total allocation of gas of 10% metered at the City of Fairhope's metering points South of Bay Minette, from United Gas Pipeline Company. SECTION 2: If the Town of Daphne, uses more than its allocation of natural gas purchased from the City of Fairhope at its supply metering point south of Bay Minette, Alabama, in addition to the change from its present rate to G-4 Industrial Rate, and the excess used by the Town of Daphne, causes the City of Fairhope to be placed under a penalty clause as set out by the. United Gas Pipeline Company by a ruling of the "F.E. R.C.", then and in that event, the Town of Daphne shall pay its proportionate share of any penalty owed by the City of Fairhope to United Gas Pipeline Supply Company, Inc. SECTION 3: That if any part or parts of this Ordinance shall be declared unconstitional by any Court of competent jurisdiction, the remaining part or parts shall remain in full force or effect. SECTION 4: This Ordinance shall take effect upon its due adoption and publication as require/fd by law. ADOPTED THIS THE _��DAY OF ,,Lfi , 1979.
