AN ORDINANCE AME DING ORD INANCE 0. 1253
KNOWN AS THE ZO ING ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFF AIRHOPE, ALABAMA as
follows :
The ordinance known as the Zoning Ordinance (No . 125 3), adopted 27 June 2005, to gether with
the Zoning Map of the City of Fairhope, be and the same hereby is changed and altered in
respect to that certain property described below:
After the a ppropri ate public notice an d hearing of th e Planning Commission of the City of
Fairhope, Alabama has forwarded a favorable recommendation ,
The property of The Grand Reserve at Pelham , LLC, generally located on the west side of US
Highway 98, just so uth of Pale Moon Court.

A map of the property to b e rezoned is attached as Exh ibit A.
The property is hereby initially zoned B-2, General Business District, concurrent with
annexation into the City of Fairhope. This property sha ll hereafter be lawful to construct on
such property any struc ture s permitted by Ordinance No. 1253 and to use said premises for any
use permitted or build ing sought to be erected on sai d property shall be in complianc e with the
building laws of the City of Fairhope and that any structure shall be approved by the Building
Official of th e City of Fairh ope and that any structure be erected on ly in compliance with such
laws , includin g the requirements of Ordinance No . 1253.
Severability Clause -if any part, section or subdivision of this ordinance shall be held
unconstitutional or inva lid for any reason , such holding shall not be construed to invalidate or
impair the remainder of this ordinan ce , which sh all continue in full force and effect
notwithstanding such holding.
Effective Date -This ordinance sha ll take effect immediately upon its due adoption and
pub li catio n as required by law.
