ORDINANCE NO. i 4
AN ORDINANCE TO ESTABLISH GAS CURTAILMENT PLAN ANI) FIXING
PRIORITIES FOR THE DIFFERENT GAS CUSTOMERS OF THE CITY OF
FAIRHOPE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
Fairhope, Alabama:
SECTIO14 I - Whenever the Gas supply is delivered to the
City of Fairhope by its supplier, "UNITED GAS PIPELINE COMPANY,,,
if not sufficient to meet the requirement of all customers of
the City served from its gas system, the City of Fairhope may
interrupt or curtail service to any customer or customers in
accordance with the following priority schedule. Priority I
shall be the highest priority and the last class of customer
curtailed. or interrupted.

All residential requirements, and those
small commercial requirements of less than
50 Mcf per day.
Large commercial, human needs & public buil�-
ing customer requirements.
Large commercial requirements other than
Priority II, and industrial requirements of
50 Mcf per day or less.
Industrial requirements not otherwise
specified.
When curtailment of gas deliveries becomes
necessary for any reason, gas volumes shall be curtailed or
interrupted pro rata among all customers in Priority IV until
all customer gas requirements have been curtailed or cut-off
point reached.
If, the curtailment of Priority IV
is not sufficient, and further curtailment or interruption is
necessary, volumes shall. be curtailed or interrupted pro rata
through each Priority, beginning with III and proceeding through
I, as necessary to satisfy each curtailment volume from the
gas supplier.
SECTIO14 III - Customers served from the City gas distri-
bution system owned and operated by the City of Daphne shall be
curtailed in accordance with the above priority system of
Fairhope. Such curtailment will necessitate reduction in

volume in gas purchased by Daphne in order to meet and abide
by the requirements of curtailment so that the results pre-
scribed by the curtailment program can be realized. On Daphne's
failure to do so, Fairhope may reduce pressure and/or volume
of gas delivered to Daphne at the three delivery points into
Daphne's system, such reduction to be based on records of
consumption available to Fairhope on its base year records.
SECTION IV - This Ordinance shall not abridge or contr-
vene any of the provisions of the contract and Court Orders
between the City of Fairhope and the Town of Daphne and they
shall remain in full force and effect, and that reductions may
made as they become necessary and under such terms as is re-
quired by the gas supplier, or as -directed by a regulatory
authority, any governmental agency or any court of competent
jurisdiction.
SECTION V - Each Section herein shall be considered
independent of the other, and any Section herein ruled un-
Constitutional by any court of competent jurisdiction, the
remaining Sections shall remain in full force and effect.
SECTION VI - This Ordinance shall take effect upon the
First day of: July, 1978, after its due adoption and publication
as required by law.
