AN ORDINANCE TO ESTABLISH METER DEPOSIT FOR ALI, ELECTRIC
USERS WITHIN THE CORPORATE LIMITS OF THE CITY OF FA.IRHOPE,
ALABAMA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA:
SECTION 1. There is hereby established an electrical.
meter deposit for all individual users of Seventy -Five
Dollars ($75.00).
SECTION 2. There is hereby established for electrical
deposit for all industrial and commercial users as follows:
1. 200 amp single phase service $ 300.00
2. 200 If 3 if$ 500.00
3. 400 If so If$1,000.00
4. 600 " " ifIf$1,500.00
5. 800 $2,000.00
6. 1000 If$2,500.00
SECTION 3. All tenants or lessees must produce either
a Social Security Card Number or Driver's License Number at
the time of making the meter electrical deposit as hereina.bove
set out.
SECTION 4. All deposits will be paid by cash or check.
SECTION 7. All Ordinances in conflict herewith be, and
the same are hereby repealed.
SECTION 8. There is hereby allowed a transfer of an
electrical :meter deposit from one location to another within
the corporate limits of the City of Fairhope, if the customer's
bill is in good standing at the time of the request for
transfer.
SECTION 9. This Ordinance shall take effect upon its
due adoption and publication as required by law.

557, ADOPTED AUGUST 11TH, 1975, AS FOLLOWS:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, THAT SECTION 4.2 THRU 4.6 OF THE CITY OF FAIRHOPE
ZONING ORDINANCE NO. 557 BE AND THE SAME IS HEREBY AMENDED I

4.21 Uses Permitted: Single -Family dwellings alnd
those uses permitted on appeal in Section 1
4.1.
4.22 Requirements for Lot Area, Lot Width, Cover-
age and other factors:
(a) Minimum Lot Area and Lot Width:
Each Lot shall have a minimum lot area
of fifteen (15,000) square feet and a
minimum lot width of 100 feet at the
front building setback line.
(b) Yard Regulations:
(1) Front: Each Lot shall have a.
min mum front yard of forty (40)
feet.
(2) Side: Each lot shall. have a tota
side yards of a minimum of thirty
(30) feet; with a minimum of ten
feet (10) on'one side.
(3) Rear: Each lot shall have a
minimum rear yard of forty-five
(45) feet.
(c) Maximum Building Height: Except as
provided or herein no structure shall
exceed this height limit provided that
the lot width is increased ten. (10)
feet for each additional_ foot added.
(d) Maximum Building Coverage: The maximum
land coverage by bui ing(s) shall be
thirty (30) percent of the total lot
area.

4.31 Uses Permitted: Single -Family dwelli
and those uses permitted in Section
4.1 and 4.2.
4.32 Requirements for Lot Area, Lot Width,
Coverage and Other Factors:
(a) Minimum Lot Area and Lot Width:
Each Lot 'shall have a minimum lot are
of ten thousand five hundred (10,500)
square feet and a minimum lot width
of seventy-five (75) feet at the
building set -back line.
(b) Yard Regulations:
(1) Front: Each lot shall have
a minimum front yard of

R-2 and R-3 District, two-family (duplexes) and
apartment clusters not exceeding four (4) units
to a structure.
4.42 Requirements for Lot Area, Lot Width, Coverage
and Other Factors:
(A) Minimum Lot Area and Lot Width: Each Lot
shall have a minimum lot area and width
as provided for in the following table:

4.51 Uses Permitted; Any use permitted in an R-L,
R- , R-3 an R-4 District, Multi -Family dwell-
ing units consisting of apartments, townho-1ises
condominiums, and similar developments. Such
structures are allowed to contain restaurants
and enclosed recreational facilities when
integrated with the building complex. Pla-_Zned
Unit Developments subject to the conditions
specified in ART.V are permitted.
4.52 Requirements for Lot Areas, Lot Width., Coverag,
and Other Factors:

STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in
regular session on Monday, January 9, 1978, at 7:00 P.M.,
at the City Administration, 387 Fairhope Avenue, Fairhope,
Alabama with the following members present: Mayor James P.
Nix; Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box,
Jack A. Stipes and Billy Don Wiggins.
The minutes of the December 27th, 1978 meeting were approved.
Councilman Sam E. Box moved, seconded by Councilman Billy D.
Wiggins, to open the bids on a new truck. Motion carried.
This being the date set for the opening of bids the following
bids were received:
1. Gaston Motor Company (5-speed) $ 8,361.92
Automatic Transmission 9,455.05
2. Thomas Pontiac 10,069.84
3. Steber Chevrolet( Automatic ) 8',918.16
Councilman Henry G. Bishop moved, seconded by Jack A. Stipes,
to accept the low bid subject to meeting specifications.
Motion carried.
This being the date set for.tlie public hearing on the rezoning
of the Strickland property from R-1 to R-4 for the property
identified as,the northeast corner of Summit Street and
St. James Street containing .92 acres more or less in order
to construct apartments containing fourteen (14) units the
public hearing was called to order.
Mr. Earl Hilyer stated that while he had no objections to the
rezoning, the traffic situation at 8:00 A.M. and 3:00 P.M., at
the Elementary School should be considered.
Mr. Jack Cummings was present at the hearing to represent
Mr. Strickland and showed the plans of the proposed apartment
complex to Council members. Mr. Cummings said that the
apartment rentals would be aimed primarily at the retirement
market.
Mayor Nix introduced the following Ordinance to change the
zoning from R-1 to R-4:

AN ORDINANCE AMENDING ORDINANCE NO. 557, ADOPTED AUGUST 11TH,
1975, BY REZONING THE FOLLOWING DESCRIBED PROPERTY TO R-4:
Beginning at the northeast corner of the intersection of Summit
and St. James Streets in the Town of Fairhope, Alabama, Baldwin
County, run north along the east side of said Summit Street ,
189 feet to the lands of the Fairhope Single Tax Corporation,
thence east along the south side of said Fairhope Single Tax
Corporation lands 213.5 feet to the lands of E.D. Corte; thence
south along west side of said Corte lands to the north side

David E. Bishop for final adoption of Ordinance No. 604;
AN ORDINANCE WHICH ESTABLISHES A PRIVILAGE LICENSE FOR
BUSINESSES OPERATING IN THE POLICE JURISDICTION. Motion
carried.
Councilman Henry G. Bishop moved, seconded by Councilman David
E. Bishop, for final adoption of Ordinance No. 605; AN
ORDINANCE RATIFYING AND AFFIRMING ESTABLISHING A PRIVILAGE
LICENSE FOR BUSINESSES OPERATING IN THE POLICE JURISDICTION
FOR THE 1978 LICENSE TAX YEAR. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman David
E. Bishop for final adoption of Ordinance No. 606; AN ORDINANCE
TO PROHIBIT THE BLOCKING OF SIDEWALKS WITHIN THE CITY LIMITS OF
THE CITY OF FAIRHOPE. Motion carried.
Mr. Richard Lacey came before the Mayor and Council on behalf of
the Merchants Association, Inc., and told Council members that
one member of the Association would be present at each Council
Meeting to act as a liason between the Merchants Association
and the City.
The increase in utility deposits on Rentals was held over
for action until the January 23, 1978 meeting of the Council.
Councilman Billy Don Wiggins moved, seconded by Councilman
Jack A. Stipes, to re -appoint Mr. Peyton Walker, Mrs. Ruth
Rockwell, Mr. Ben Barnhill and Mr. Ray Malone to the Parking
Authority Board and to Appoint Mr. W.C. Dukes as a member to
the Parking Board. Motion carried.
Mr. Peyton Walker was reappointed to serve as a member of the
Parking Authority Board until January of 1980.
Mrs. Ruth Rockwell was reappointed to serve as a member of the
Parking Authority Board until January of 1980.
Mr. Ben Barnhill was reappointed to serve as a member of the
Parking Authority Board until January of 1981.
Mr. Ray Malone was reappointed to serve as a member of the
Parking Authority Board until January of 1981.
Mr. W.C. Dukes was appointed to serve as a member of the Parking
Authority Board until January of 1981.

under the discretion of the Court.
SECTION III. Special permission shay be granted by the

SECTION IV . That this ordinance shall take effect upon
its due adoption and publication as required by law.
