HomeMy WebLinkAboutO-595ORDINANCE NO. 595 AN ORDINANCE TO REGULATE THE USE OF THE FAIRHOPE MUNICIPAL FISHING WHARF AND RELATED MATTERS THERETO. BE IT ORDAINED BY THE CITY OF FAIRHOPE, ALABAMA, AS FOLLOWS: SECTION 1. That in order to insure that all users of the Fairhope Municipal Fishing Wharf shall be on an equal basis, the docking facilities shall be rented as follows: (a) The sum of $1.00 per foot of the width of the boat per month, minimum $100.00, and on an annual basis by and through the Harbor Board and shall be leased on a first come -first served basis in the following order of preference: 1. Commercial Fishermen, 2. Fairhope Citizens, 3. Fairhope Police Jurisdiction Citizens, and 4. Baldwin County Citizens. (b) Only one boat slip will be leased per person unless otherwise authorized by the Harbor Board. (c) Leasees of slips cannot rent or sub -lease to other boat -owners. He may lend his slip to another with written consent from the Harbor Board. The Leasee can be requested to move to another slip if deemed necessary by the Harbor Board. SECTION 2. All boats using the Loading Ramp shall be responsible for its cleanliness, and all boats shall be removed immediately after off-loading or taking on fuel and ice. SECTION 3. The slip rentals as hereinabove set out shall be paid on an annual basis beginning on August 15 of each year and renters shall be notified by the City on or before July 15 of each year that the rent is due and payable on or before August 1 of each year. Rentals not paid by August 1 will mean the renter forfeits his slip and the Harbor Board will re -rent the slip according to their waiting list. The boat slip must be vacated on or before August 15. If the renter fails to vacate after notification by the Harbor Board, the boat will be removed by the Harbor Board and all charges will be paid by the boat ow SECTION 4. Any boat owner using a slip without a current lease or permission from the Harbor Board shall, on conviction, be fined no more than $25.00 for the first offense and not exceeding $100.00 for any subsequent offenses, at the discretion of the trial judge. SECTION 5. Boat Operators without rental slips shall be allowed to off-load at the Loading Ramp but shall be charged $1.00 per 1,000 pounds of fish, or any part thereof; and $1.00 per 500 pounds of shrimp, or any part thereof. Off- loading shall be at designated areas. SECTION 6. No nets or other gear is to be left on the docks but are to be on -boarded as soon as fish or other cargo has been off-loaded. SECTION 7. Any person, firm, or corporation or any agent, servant, or employe( thereof, found disposing of fish, garbage, litter, etc., in the waters or within the Municipal Fishing Wharf area shall, on conviction, be fined not less than $25.00 nor more than $100.00 at the trial judge's discretion. SECTION 8. Ordinance No. 430 be and the same is hereby repealed. Any and all other Ordinances in conflict herewith be and the same are hereby repealed. SECTION 9.
