ORDINANCE
AN ORDINANCE TO PROHIBIT ANY FIRM, CORPORATION, OR AGENTS
THEREOF FROM USING THE GARBAGE DUMP OF THE CITY OF FAIRHOPE,
ALABAMA, TO DISPOSE OF CLEARINGS FROM ANY VACANT LOT, DEMOLITION
OF ANY HOUSES, OR OTHER STRUCTURES, AND TO PROHIBIT THE DISCHARG
OF ANY OTHER UNLAWFUL WASTE INTO THE GARBAGE DUMP OF THE CITY
OF FAIRHOPE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABA.MA :
SECTION 1- It shall be unlawful for.any firm or c6rporatio.
or any agent thereof, to use the garbage dump of the City of
Fairhope, for the disposal of the clearings of any vacant lot,
including but not limited to trees, limbs, stumps, trash, or
other debris, or the dumping of any lumber, brick, stones, morta
or any other debris from the demolition of any house, building,
or other structure, or to use the City Dump for the disposal of
any unauthorized disposable trash and garbage, without prior
approval of the City.
SECTION 2- Any person found to be in violation of this
Section shall be punished by a fine of not more than $ 200.00
or by imprisonment at hard labor for not more than 6 months,
or both, such fine and imprisonment at the discretion of the
Court.
SECTION 3. This Ordinance shall take effect upon its due
adoption and publication as required by law.

LAUREL STREET, CHURCH STREET, CHESTNUT STREET, THIRD AVENUE,
(I� FIG STREET, WISTERIA STREET, SCHOOL STREET, LINCOLN STREET,
f b WOOD GROVE CIRCLE, ORCHARD DRIVE, SPRING RUN, EAST GATE
J DRIVE, AUTUMN DRIVE, RONFORTH DRIVE, AND KURLANE STREET.
BE IT ORDAINED by the City Council of the City of Fairhope,
Alabama as follows:
SECTION 1, That the following described streets in the City
of Fairhope, Alabama shall be improved as hereinafter
provided between the respective terminal points hereinafter
set forth:
(a) LAUREL STREET: From the east edge of the pavement on
Laurel Street, at its intersection with Satsuma Street,
easterly approximately 1400 linear feet, more or less, to
the east end of a temporary turn around.
(b) CHURCH STREET: From the south edge of the pavement at
the intersection with Fig Street, south approximately 600
linear feet, more or less.
(c) CHESTNUT STREET: From the south edge of pavement on
Pecan Street, south to Fig Street, approximately 10BO

linear feet., more or less.
(d) THIRD AVENUE: From the south edge of pavement on Pecan
Street, south to Fig Street, approximately 900 linear feet,
more or less.
(e) FIG STREET: From the east edge of pavement on Fig
Street at its intersection with Chestnut Street, to the
south end of Third Street, approximately 350 linear feet,
more or less.
(f) WISTERIA STREET: From the south edge of pavement on —
Nichols Street, south to the north edge of pavement on Dog—
wood Avenue, approximately 660 linear feet, more or less,
and from the south edge of pavement on Dogwood Avenue, south
approximately 300 linear feet, more or less.
(g) SCHOOL STREET: From the south edge of pavement on
Nichols Street, south to the north edge of pavement on Dog—
wood Avenue, approximately 660 linear feet, more or leas,

approximately 300 linear feet,.more or less.
(h) LINCOLN STREET: From the south edge of pavement on
Gayfer Street south approximately 250,linear feet, more or
less.
(i) WOOD GROVE CIRCLE: From the east edge of pavement on
Blue Island Avenue to the east end of a cul—de—sac in Wood
Grove Subdivision, approximately 257 linear feet.
(j) ORCHARD t)RIVE: From the east edge of pavement on Blue
Island Avenue to, the east end of a cul—de—sac in Wood Grave
Subdivision, approximately 257 linear feet.
(k) SPRING RUN: From the east edge of pavement on Greeno
Road, easterly approximately 1200 linear feet, more or lass,
to East Gate Drive in East of the Sun Subdivision.
(1) EAST GATE DRIVE: From the east and of Spring Run, south
approximately 1100 linear feet, more or less, to the east end
of Autumn Drive in East of the Sun Subdivision.
(m) AUTUMN DRIVE: From the south end of East Gate Drives
westerly to the east edge of pavement of Greeno Road, approx—
imately 1200 linear feet, more or less, in East of the .Sun
Subdivision.
(n) RONFORTH DRIVE: From the north end of the pavement on
Ronforth Drive northerly to the south edge of pavement on
Fanwood Blvd.., approximately 600 linear feet, more or less.
(o) KURLANE STREET: From the west end of the pavement on
Kurlane Street, southerly approximately 650 linear feet,
more or less, to an intersection with Ronforth Drive.
Improvements to the hereinabove described streets
shall be as foll-ows;
(a) Both edges of a 25 foot roadway, the centerline of which
shall be approximately in the center of the dedicated right
of way shall be curbed and guttered with Portland Cement Con—
crete combined curb and gutter 6 inches thick and 2.5 feet
wide; the curb lines of said gutters shall be connected with
the curb lines of all intersecting streets, with Concrete
combined curb and gutter as above described, o,f,suitable
radius and the surface between the gutters to be constructed

shall b, ..,)roved by paving with Bituminous Plant ,,2
inches thick on a 6 inch compacted sand clay foundation;
seid improvement shall include grading, paving, and all neces—
sary drainage structures, including concrete culverts, con—
crete pipe, valley gutters and drop inlets; manholes of brick
with cast iron covers shall be constructed or reconstructed
where needed.
(b) Where sanitary sewer lines are included as a necessary
part of the street improvements, the said sewer lines shall
bEr constructed with Vitrified Clay Sewer Pipe, to the diameter,
location, and grade as shown on the plans and specifications;
avid improve Mint shall include all sewer lines, laterals,
manholes, fittings, pump stations and force mains, trenching
and trench bracing, backfilling and restoring the site and
roadway surfaces, as necessary, to complete the work.
(c) Where wager lines are included as a necessary part of
the street improvements, the said water lines shall be
constructed with class 150 cast iron or ductile iron pipe,
or class 160 P.V.C. pipe, to the diameter and location as
shown on the plans and specifications; said improvement
shall include all water lines, service lines and connections
to the water main, Fire Plugs, valves and fittings, tren—
ching, backfill and restoring the site and roadway surfaces
as necessary to complete the work.
SECTION 2. That the full details, drawings, plans, speci—
fications and surveys of the above described work and estimates
which have been prepared by Moore Engineering Company, who
has been duly designated and appointed City Engineer by this
Council, have been fully considered and studied by this..
Council and hereby are adopted. Said details, drawings, plans,
specifications, surveys and estimates shall, be immediately
placed on file in the Office of the City Clerk of the City of

Feirhope, Alabama, where property owners who may be affected
by such improvements may see and examine them.
SECTION 3„ That improvements hereinabove described shall
be made in accordance with the grades heretofore established
by Ordinance and according to the full details, drawings,
plans, specifications and surveys of said work and estimates
hsrein adopted, all under the supervision of the City
Engineer.
SECTION 4. That the cost of constructing said improvements

shall be assessed against the property abutting on 6he por—
tions of these streets.so improved, provided:
(a) That the cost of street improvements, including curbing
and guttering on street and avenue corners shall be assessed
against the lots or.parcels of land abutting on or nearest
to said improvements, and the cost of street improvements,
including curbing and guttering at the intersection'of any ._
alley With a street, avenue or other highway shall be ,asses—
sed in fair proportion against the respective lots or parcels
of land abutting or cornering on the alley at such inter—
section.
(b) That no assessment shall exceed the cost of the improve-
ments or the increased value of such property by reason of
the special benefits derived from such improvements.
SECTION S: That the City Council shall meet on the 23rd
day of Me),, 1977 at 7:00 P.M., at the City Hall in the City
of Fairhope, Alabama, to hear any objections, remonstrances
or protests that may be made against said .improvements, the
manner of making the character of materials to be used.
SECTION 6: This Ordinance shall be published once a Week
for two (2.) consecutive weeks in the Fairhope Courier, a
ne,ispaper published and of general circulation in the City
of Fairhope, Alabama, the date of the first publication to
be not less than two (2) weeks before the 23rd day of May,
1977.
SECTION 7: A copy of this Ordinance shall be sent by Regis—
tered Mail, Postage prepaid, to the persons last assessing
for City taxation the property which may be assessed for
said improvements, at their last known addresses, said noti—
ces to be so mailed by the City Clerk not less than ten (10)
da;Ys prior to the 23rd day of May, 1977.
SECTION 9: This ordinance shall become affective, upon its
due addoption and publication as required by law.

business shall be charged with a minimum rate for water and a
minimum rate for sewer for each unit, or the proposed rate,
whichever is greater.
Section 7.- This Ordinance shall become law upon its due
adoption and publication as required by law.
