HomeMy WebLinkAboutO-543IMPROVEMENT ORDINANCE NO. 543 AN ORDINANCE MODIFYING, AMENDING AND CONFIRMING, AS SO MODIFIED AND AMENDED, IMPROVEMENT RESOLUTION ADOPTED ON THE 9th DAY OF SEPTEMBER, 1974. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE ALABAMA as follows: SECTION 1. That upon evidence presented to and considered by it, the City Council odes hereby make a finding and determina- tion of the following facts: (a) At a regular meeting of the City Council of the City of Fairhope, held on the 9th day of September, 1974, Improvement Resolution was adopted and notice of the adoption of said Resolu- tion was given by publication of said Resolution in the FAIRHOPE COURIER, a newspaper published in and of general circulation in the City of Fairhope, Alabama, in the issues of September 12 and September 19,1974, which said Resolution stated that the City Council of the City of Fairhope would meet on the 30th day of September, 1974 at 7:00 o'clock P.M. at the City Hall in the City of Fairhope, Alabama, to hear any objections, remonstrances or protests that might be made to said improvements or the character of the material or materials to be used, and the manner of making the same. (b) A copy of said Improvement Resolution was sent by regis- tered mail, postage prepaid, to each of the persons last assess- ing for City taxation the property proposed to be assessed for said improvements at their last known addresses; said notice havii been mailed on the 20th day of September, 1974, ten days prior to the 30th day of September, 1974. (c) The protests and objections of persons owning property on Bon Secour Avenue from Frederick to Grand, namely, Dr. Pierce Frederick and Mr. Paul Frederick, to the improvement on Bon Secour Avenue from Frederick to Grand were heard, considered, sustained and granted, and improvement Resolution amended and modified by the elimination of the improvement on Bon Secour Avenue from Frederick to Grand. (d) The protests and objections of persons owning property on Chestnut Street, namely: 0. D. Dunn and Melvin Wagner, to the improvements on Chestnut Street were heard, considered, sustained and granted, and Improvement Resolution amended and modified by the elimination of the improvement on Chestnut Street. i (e) The protests and objection of persons owning property on Laurel Street, namely, George Connors, Wm. Shaphard, Billy Sloan, Jimmie Sproels, John H. Owens, Dyson, Eldon Harrington, G. D. Myers, William Richman, Mrs. Marie Patterson, to the improve- ments on Laurel Street were heard, considered, sustained and granted, and Improvement Resolution amended and modified by the elimination of Improvements on Laurel Street. (f) The protest of Mr. Brister, by letter, to the improve- ments on Lincoln Street was heard, considered and granted and Improvement Resolution amended and modified by the elimination of the improvements on Lincoln Street. The Fairhope Single Tax Corporation withdrew their request for paving Lincoln, Chestnut, Blue Island, Mershon and Brown Streets and on motion by Councilman H. G. Bishop seconded by Councilman Sam Box, Improvement Resolution was amended and mod- ified by the elimination of the improvements on Brown Street and Mershon Street. No other protests, objections or remonstrances against said improvement, or the character of materials to be used and the manner of making said improvements have been filed in writing with the City Clerk or in her office, or have been made at this meeting, and said Improvement Resolution is hereby modified and amended as follows: SECTION II - That the following described streets in the City of Fairhope, Alabama shall be improved as hereinafter provided between the respective terminal points hereinafter set forth: A. Winn Lane from the east side of the existing pavement on Blue Island Avenue 617 feet eastwardly to the west side of exist- ing pavement on Ingleside Avenue ; B. Northrup Street, from the east edge of existing pavement on South Ingleside Avenue east- wardly 875 feet to the eastern end of the cul de sac that termina- ted said street; C. Burgundy Street, from the east edge of exist- ing pavement on Church Street eastwardly to the west edge of existing pavement on Burgundy Street at Boone lane 685 feet; Each of said streets to be improved as follows: a 20 foot bitumi- nous concrete pavement 12 inches thick (150 lbs per square yard0 to be laid over a 6 inch thick compacted, primed, granular soil base constructed between 2.5 foot wide 6 inch thick portland cement concrete valley gutters; together with brick manholes and catch basins where necessary with metal or concrete covers, con- crete culverts, concrete pipe, drop inlets, grading, clearing, grassing and sodding as necessary for erosion control and effect- ive completion and protection of said streets. D. Blue Island Avenue, from the north edge of the existing pave- ment on Fairhope Avenue northwardly 1840 feet to the existing pavement on Blue Island Avenue at Winn Lane, shall be improved by the construction of all of the construction items listed above together with such additional metal pipe and concrete pipei culverts necessary to substantially control erosion along said street and also including construction of the 1285 linear feet of li 8 inch vitrified clay sanitary sewer (with standard manholes and laterals) that will connect to the Fairhope Avenue sewer line by gravity flow.
